Legalizing of Same Sex Marriage Introduction According to the religious and legal status of US,marriage is regarded as a connection between a male and a female and is even considered as the eventual way to express love. Relationships that are homosexual in nature are gaining acceptance within the society of US, still the legal system has not accepted it as a legal relationship between two individuals. The public and the interest groups are using their voice in the favor of same sex marriage and such marriages are already on a rise and the family structure is changing. Same sex marriage should be legalized on the grounds that they are socially acceptable, certain states have started accepting this kind of marriage, this kind of marriage results in the wellbeing of the society and those who are against same sex marriage are conducting an act of discrimination. Body Deniability of same sex marriage is against religion even though religious groups state that such marriages are equal to conducting a sinful act. According to the 1st Amendment, an individual’s religious views should be protected by the state. Marriages are divided between religious and civil marriages and if rules and regulations are made against marriage on the basis of religion, then the policy makers are working against the fact that marriages are a worldly act. Marriages of any kind result in several benefits for the involved couples, marriages have an impact on filing of taxes, property ownership, benefits of insurance and law of agency. Marriages have a positive impact on several decisions, for example: if one of the couples involved in a gay relationship end up getting sick and is hospitalized, the other couple will only be allowed to meet him/her if same sex marriage is legalized. This is because without the legalization of same sex marriage, the couples ill not be allowed to meet and will result in emotional sufferings for the couples. The law requires that medical decisions regarding an individual can be made by her marriage partner and not by those individuals with whom the patient shares an intimate relationship without marriage. If same sex marriages are not legalized, gay couples may only be recognized as individuals who are sharing an intimate relationship and may not be able to take decisions on each other’s behalf. Same sex relationship has gained acceptance within the society and it is backed by biological evidence. These relationships have been in existence since the Greek and the Roman period, the very term lesbian is not a new term, it was developed by the Greeks. Greeks had a region recognized as Lesbos and in these regions, people having same sex relationships lived in these areas. It is commonly believed that such relationships are a result of genetics, but the truth is that such relationships are caused due to biological reasons. Researchers state that individuals experience hormonal switch due to which individuals get attached to others. They say that those who are attracted to same genders is because of their hormonal switch due to which they are attracted towards same sex rather than being attracted to opposite sex. Those who deny and do not accept such kind of relationships are working against the constitution of US. The US constitution is based on the concept in which majority is said to be the elite but the majority needs to accept and protect the rights of the minority. Due to this concept several legal rules and regulations have occurred such as anti slavery laws, bill of rights and the law of equal opportunity. The equal opportunity law states that all individuals should be treated equally and should have access to equal opportunities. If same sex couples are not allowed to get married legally, they are deprived of the equal opportunity right. The deniability of same sex marriage is pointless because such marriages do not have a negative impact on the society. Same sex marriages are similar to straight marriages where two people get into a relationship with each other and this relationship is not impacting others in the society. Marriage is an institution based on pure love and affection, when two people get married; they accept each other in any condition and in any state and promise to assist each other in any situation. Similarly, individuals having a same sex relationship love each other and accept each other and are ready to assist each other in any situation. Certain states have accepted this kind of relationship under the rule of civil union in which two individuals join each other but are not regarded as married couples. Political figures have been voicing their opinion against such marriages but they have accepted that law of different states should decide whether this kind of marriage should be made legal or not. In US there is a legal concept that states that if a certain state has accepted an act as a legal act then other states have to respect the legal status of that act. This means that if a couple gay or lesbian couple has married each other in a state where the marriage is recognized as legal, then in other states their marriage should be accepted as a legal institution. In some way or the other, if one state accepts same sex marriage, then other states will have to accept it directly or indirectly. A major issue experienced by the world and US is that the number of children without parents is increasing on day to day basis. These children need a family to develop and live within the society. The number of children up for adoption can be decreased through same sex marriage and these children will have more importance than they would have if they would have been adopted by straight marriages. This is because straight individuals can create children but the inability of homosexuals to create children will increase the importance of children in their lives. There are several reasons due to which legalizing of same sex marriages have been criticized. Religions throughout the world have regarded such marriages and such relationships as an act of sin. The rules and regulations set by the legal system of certain nations is based on religious grounds and even in US the bible provides ample amount of support to the legal side of the US, thus policy makers state that they can not go against bible and legalize such relationships. Criticizers believe that such marriages will weaken the already vulnerable institution of marriage. The institution of marriage has already become quite vulnerable because of high rate of divorces within the nation. Criticizers even state that if gay marriage is legalized, individuals who are not even in same sex relationships will try to manipulate but getting married with gay and lesbian partners in order to decrease the amount of taxes they have to pay. Criticizers even state that same sex marriages are senseless as these marriages do not result in creation of contemporary family as these marriages have failed to produce children. Legalization of such marriages will dent the traditional family system which has already been damaged by those who live in a live in relationship without getting married and even those who have started to prefer living alone over living with a partner. Those in the favor of rights of individuals wanting same sex marriage state that this kind of marriage does not hurt or affect any individual within the society. The problem with legalizing this form of marriage is that it would result in protests and demand for other forms of rights. For example: there are those who want to have multiple wives at one time, then there are may be those who want marriage with an animal to be legalized and several such issues regarding the institution of marriage will arise. To put a stop to such types of marriages, a proper definition of marriage is required which should even include marriage between people from same sex to ensure that the institution of marriage is not damaged. Children are taught to grow up either as a male or a female; they learn about the roles they have to play as a male or a female and what roles are expected by the society from them. If parents having similar sex raise children, they7 will not be able to exhibit the differences between female and male roles and thus children will fail to survive in the society as they will fail to stand up to the expectations of the society. Conclusion The issue of same sex marriage has been under debate and scrutiny for several years and this matter needs to be taken up seriously and same sex marriage should be legalized. Same sex intimate relationships are on a rise, they have been within society for several years, the difference between now and then is that, now these relationships have become public and before these relationships were practiced in a secretive manner.
