Homicide Homicide is the killing of a person by another person. Homicides can be categorised as either legal or illegal. A legal homicide is justifiable under the rule of law; some of the examples include when a police kills a suspect during a confrontation or when a person kills another in self defense. An unlawful homicide is classified specifically as crimes which consist of murder and manslaughter. Manslaughter is the unlawful killing of a person but without malice aforethought. Manslaughter therefore has a minimal moral blame as compared to first degree or second degree murders. It has a lesser punishment than murder, but it also regarded as a serious crime (Berman Para 1). Manslaughter has two main variations namely voluntary and involuntary manslaughter. Voluntary manslaughter also called ‘heat of passion’ occurs when an offender is compulsively provoked or; when the offender kills due to the heat of passion caused by provocation. The heat of passion arises when a person had reasonable time to calm down but instead killed intentionally. The offender’s moral blame is reduced due to the emotional context the offender encountered (Berman Para 2). Involuntary manslaughter arises when a person commits unintentional homicide due to the person’s reckless or criminal negligence behavior. It can also take the form of unintentional killing due to the commission of crime which is different from felony. Contrary, accidental killing due to severe recklessness can lead to second degree murder (Berman Para 2). Murder is defined as the intentional killing of a person unlawfully and with an aforethought malice. However, malice aforethought cannot always be termed as intentional killings. It only exists if the killer inflicts serious body harm to the victim that leads to his or her death or; reckless and extreme behavior that disregard human life leading to the victim’s death (Molan 34). In the court of law, murder can be classified as either first degree or second degree murder. First degree murder occurs when the killers had malice aforethought and their actions having a serious effect than others. The killings that involve malice but do not constitute first degree, is the second degree murder. Every state has a jurisdiction as to the scope of the first degree murder (Molan 35). In first degree murder, the killing is premeditated and deliberate. This means that the killer had the intention of killing and also had the time to plan on the occurrence of the illegal act. The time duration does not matter whether the offender took minimal time or enough time in determining the course of the victim’s death, the preplan solidifies everything (Molan 44). It can also conclude to first degree murder if the killing is caused by the offender’s dangerous felony. Also called felony murder, arises when a felon is guilty of murder, if the death occurs during a dangerous felony; even if the offender is not a killer. In this regard, Mr. Fernandez was guilty of the first degree murder for Alkadi’s death (Molan 53). Recent Violence Activity That Happened In Central California Introduction The research of the case is based on the murder of a young Saudi Arabia national who was cruelly murdered by his potential customer. The young man had posted an advert regarding the sale of his vehicle on an online marketing network, after which he met a potential buyer who ended up killing him at his residence (Moreno, Pamer and Wynter Para 1). The case involves the death of Abdullah Abdullatif Alkadi from California State University, Northridge; who was brutally murdered in a terrific online transaction. The 23 year old Saudi Arabian national’s body was found severally stabbed and damped at 10 Freeway near Palm Desert in Los Angeles State. The CSUN student was a degree student majoring in Electrical Engineering who last disappeared on September 17, 2014 after his online transaction turned brutal (Moreno, Pamer and Wynter Para 2). The late Mr. Abdullah Alkadi had posted an online advert for the sale of his posh Audi A6 car. It is through the online transaction that led to the death of this young man’s life. The accused killer Mr. Agustin Rosendo Fernandez, 28 years of age, got involved when he was interested with the purchase of the vehicle. The accused agreed with the late Alkadi to meet at the young man’s house in order to discuss the details of the transaction (Moreno, Pamer and Wynter Para 3). The late Alkadi resided at the 9900 block along Reseda Boulevard in Northridge. The defendant Mr. Fernandez took advantage of the situation due to the closure of the deal at the late man’s residence, where he ended up stabbing him multiple times and took along his car and some other personal possessions. The case is predominantly taken as a homicide; the accused having been found possessing the evidence of the crime during his arrest and having been charged with a criminal offence before (Eisner Para 3). Mr. Fernandez, who comes from Long Beach, allegedly used a knife to kill the student after having ill motives of taking the car and his cash freely without the deceased consent. The case was treated as a capital murder, the accused having been found with the evidence of the fatal case. Mr. Fernandez was later arrested and charged of the capital offence at the San Fernando Superior Court. The defendant through his attorney pleaded for the postponement of his case, which was later pushed on to January 21st of 2015 (Eisner Para 2). Prior to the death of Mr. Alkadi, the deceased brother; Ahmed Alkadi who is also a student at the California State University, was desperate for finding his sibling. According to the Los Angeles Police Department, Homicide Division; the deceased was a full time student who was last seen on September 2014 at around noon, at his residence in Reseda Boulevard (Eisner Para 3). His brother Ahmed reported that it was rare for Alkadi to spend days without calling his parents back at home in Saudi Arabia or his relatives here in US. Ahmed further explained that his late brother loved schooling and he really wanted to accomplish his dream. It was noted their parents were prominent people in Saudi Arabia. Salman Al Mutawa, the deceased family friend, explained that their parents in Saudi Arabia suffered shock after the hearing tragic news about their son’s death. He further added that the parents could not believe the sad news because they sent their son to study and not to get involved in such a situation or the problem that begotten their son (Eisner Para 6). The deceased brother further illustrated that Alkadi had initially sold another Audi car S-5 to another buyer through the same medium, Craigslist. The vehicle had a retail price of fifty two thousand dollars. There was an issue in October when the police reported that the owner found with the car at that time, was not responsible for the murder. That police report still has a lot of suspicion up to date. There were allegations that the police provided this information in order to buy time to conduct thorough investigations (Eisner Para 3). The student having been of a foreign origin, the Federal Bureau of Investigation (FBI) also decided to help. According to the Los Angeles daily news, the police department through detective Frank Flores reported that the FBI offered to assist in the investigations of the missing student. The student was a third year student in Electrical Engineering was reported missing by his brother on September 18. The student was last seen the previous night before he disappeared by his roommates (Eisner Para 7). The deceased was last seen on September noon wearing blue jeans, beige shorts and a blue shirt. The body identified at the Palm desert matched the description given by the family. Abdullah was five feet and three inches tall and weighed one hundred and ten pounds. The description was later identified by the police as matching the family’s description. The deceased was later traced in Beaumont city through the calls he had made before succumbing to death. However, the deceased is believed to have no contacts at the crime scene (Eisner Para 8). According to the Los Angeles police boss Charlie Beck, Alkadi wanted to sell his Audi A6 vehicle at a cost price of thirty six thousand five hundred US dollars, where the defendant wanted to retain both the cash and the car for free. During the time of his arrest, Fernandez was caught having Alkadi’s Audi A6 car and some other key evidences. The vehicle contained the case evidence which were related with the murder weapon that was used during the foul killings (Song Para 6). Beck, the Los Angeles police chief said during a press conference that the deceased was severely and severally stabbed by the accused and this was clear as the defendant’s car contained the ill fitted evidence. The defendant had responded to Mr. Alkadi’s advert which was posted on the Craigslist. Based on the county inmate report, Fernandez previously had been reprimanded for criminal charges. He was caught the same day that Mr. Alkadi’s body was found, following his possession of the deceased car and the homicide evidence (Song Para 9). The suspect having been found with the car during his arrest denied the murder allegations. On the contrary, the suspect provided the police with key information to the LAPD police department. The LAPD department later on contacted the Riverside County Sheriff office where they found the students body the following day (Song Para 8). When the student went missing on September 17, the Riverside County Coroner’s Office came to confirm the discovery of the missing body. Based on the KESQ news report, the body was found along the Cook street and the Washington street. After the discovery, the LAPD conducted an autopsy where they concluded the body was indeed Abdullah Abdullatif Alkadi (Song Para 9). In connection with the cold blood case, two people were later arrested, but they never provided any new information. Henceforth, one was left in custody while the other one was released. It is also not known whether charges would be pressed against the released suspect. The LAPD police boss Mr. Beck stated that during motor vehicle transactions, it is always so dangerous when money exchange hands (Song Para 8). The police department explained that the body was found at 11.30 p.m. at the cook street. The police further gave out help lines to the public for the whereabouts of Alkadi. The LAPD through the Missing Persons Unit gave out the help line number (213) 996-1800 and 1-877-LAPD-24-7 so as to receive the details of the case. The help line numbers were to reach Detective Carlton whether in the course of business hours or non business (Reynolds Para 5). During the case investigations, the police managed to track his online profile information in order to shade more light regarding the details of the incident. The LAPD chief Charlie Beck reported that the deceased had several conversations on his online site before he met the rogue buyer on the Septemeber 17. The police believe the suspect Fernandez kept the money, then took the car and later on stabbed Alkadi before damping him along the Palm desert for dead (Reynolds Para 5). The police chief was not so surprised about the case; this is because he confirmed that such cases usually happened too frequently in the Los Angeles state. Additionally, he presented that when any type of deal is about to come to success and there is the possibility of money exchanging hands; that was the most dangerous moment. He insisted that people should be extra keen during such moments and take precautionary measures (Reynolds Para 6). The suspect was arrested by the LAPD on Thursday at 8 a.m before the student’s body being found. He was later booked on Friday morning. Alkadi’s body was found on Thursday night at Palm desert, but the police chief could not explain how the body reached that place being one hundred and fifty miles from Alkadi’s home. During the Monday conference the police chief declined to answer crucial answers pertaining to the case, for the fear of jeopardizing the prosecution’s evidence to infer conviction on the suspect. Alkadi’s parents having been intensely shocked by the murder of their son could not make any statement regarding the incidence. On the contrary, his parents were busy making plans for the transportation of their 23 years old son back to his home land, Saudi Arabia (Reynolds Para 6). After the defendant being arraigned in court, he was charged with one count of capital murder with special conditions. The charge included murder with robbery as well as murder with carjacking. He however pleaded the postponement of his hearing which he was later granted but without bail. Mrs. Jane Robinson the district attorney alleged that the accused used a personal deadly weapon, which was a knife (Reynolds Para 6). Under the prosecution’s side, Agustin Rosendo Fernandez having been found with the capital murder offence faces the chances of getting a death penalty. Based on the Los Angeles District Attorney’s report, the prosecution will decide whether to accord him the death penalty or a life sentence; in that case, without the chances of parole (Reynolds Para 6). Conclusion In regards to the murder cases, many states have compulsory minimum charges for the offense. The compulsory charges for the first degree murders are usually heavier than the second degree murders. The offenders convicted of the first degree murders are also normally eligible for death penalties; and without the chances of parole (LWOP).
