Both lying and misrepresentation of facts present someone or something as contrary to claims about them. In court cases, both are civil wrongs that result in loss.
An outline of your essay that demonstrates the similarities and differences:
- Misrepresentation involves planning and systematic distortion with awareness of the consequences.
- Lying involves responding to situations through quick decisions without awareness of the consequences.

My motivation to study English law as my major evolves from different factors. First, as a lawyer, I would manage to assist other people to attain justice within the English law system and have the opportunity to do my best since I love working under lots of pressure. For a long time, most court cases require a superb track record in successfully handled cases, and despite my little experience, I believe that such records are attained by lawyers who engage in intense research and lots of accuracy and attention to detail. I also trusted my confidence and strong communication skills since most situations that had to deal with always demonstrated a material difference. For instance, I contributed immensely to the success of a mock local campaign that involved verbal and written evidence in a situation that required compensation of Australian Aboriginals for the oppression received from white colonialists.
A good boss must contribute to social change, and be influential, sensitive to, and flexible in the ever-changing business environment. Being influential means getting their followers to not only accept but also respond to their persuasion through wanting to do what should need to be done. Good leaders are thus great communicators using visionary ideas that impact a strong imprint of ideology on their followers. Sensitivity to changing business environments facilitates the identification of new trends, the development of strategies to improve, and the flexibly develop of fresh knowledge and systems to handle arising changes. Such bosses also encourage others to adopt rules, roles, and norms that propel responsiveness to change through the strong decision and problem-solving strategies. Good bosses also promote social change by ensuring that their employees assist each other to attain a common mission and goal.
Good bosses:
- Are sensitive to changing business environments and flexible to adopt strategies to cope with changes.
- Contribute to social change by encouraging employees to support each other to accomplish common goals.
- Are influential such that followers accept and respond to their persuasion.
In most instances, the poor in society who end up in court cases with wealthy people tend to lose. However, as a defense lawyer in such cases, no specific areas to attack the credibility and impeach the testimony of witnesses coached in favor of the wealthy.
Attacking the credibility of the witness’s knowledge and exposing how they lack first-hand knowledge (Zavatsamos, 2010, pp. 4-6). Consequently, the witness’s lack of personal knowledge of events leading to the case makes it impossible to give extrinsic evidence.
The successful discrediting of the witness’s credibility is followed by proving that even though the witness is familiar with the questionable events, they were not witnesses to those events. This I do by demonstrating that the witness just learned from others what they proclaim.
At this point, I can then discredit the testimony through lack of reliability by pointing out defects in their capacity to recollect and observe events. This also involves questioning the selective memory of the witness where the witness’ disposition for all questions is scrutinized to pinpoint the question that was not answered.
Finally, the witness is impeached by proving their misrepresentation of or lying about the facts.
