I am against the proposed regulation because it has limited applicability in the actual situation. It fails to recognize other businesses such as retail trade enterprises as part of small businesses. Further, it represents just the opposite by stating that a small business is a standard-sized business including its subsidiaries.

            The date was 8th January 2013. the comments which were due include the regulation was set to help business assess their position (Regulations.gov.para-2).

5. a). To what does your comment's submission legally entitle you? In other words, once you have submitted your comment, what will you be legally entitled to do later in the promulgation process.

Answer:

            Once my comment has been submitted and acceptable my business will be able to fall under the definition of small business as explained by the small business administration. This will further make my business qualify for government contracts and financial assistance.

5. b). I the proposal passes, identify and explain the five legal challenges you could use in an attempt to have the regulation declared invalid and overturned. 

Answer:

            The first challenges are critics from the supporters of that regulation as they may feel I am against their ideas and wishes

            The second challenges are legal litigations from policymaker while the third challenge is time and money may be required due to consultation before taking a decision.

            The third challenge is that the process followed in declaring a regulation invalid may be tedious.

            Finally, a Lack of corporation from supporters may affect the regulation-making it unachievable. Some people may tend to behave in a manner that they think is correct.

5. C). Which of these challenges would be the best way to challenge the regulation you selected for this assignment and why?

            The best way to challenge the regulation is to follow the due process of amending regulation and explain how the proposed regulation fails to be met (Regulations.gov.para.4)
