If the consent of one of the parties consent is obtained by force or is proven to be under duress, or obtained fraudulently.

In a criminal case, the verdict of guilty or not guilty must be unanimous since the acts are considered to be against the state and the state is responsible for enforcing the law.

Criminal juries in felony cases can comprise less than twelve persons with the minimum number being a petit jury of six people who must have a unanimous verdict.

In civil cases, either party is eligible to request a jury trial except if the judge believes that the facts of the case, evidence, and other matters are extremely complicated for a jury trial.

Basing my reasoning on all the statutes that determine burglary I do not believe the client committed the alleged offense. All the clients’ actions can be argued not to amount to the offense in question. It is not my belief that the client committed burglary by entering his neighbor`s house and stealing a television set. The crucial statutes which determine the act of burglary include unlawful entry into the building or any part of the building, intention to steal the television set at the time of entry, and the statutes of the building or dwelling place that have not been met (Cromwell, 74).

The burden of proof will lie with the prosecution to prove that the client had an actual intention to commit the crime of stealing the television upon entry into the neighbor’s house. Since the neighbor was away at work when the client allegedly entered his house, there are possible reasons that the client went to the neighbor`s house to check on him (Cromwell, 70). The actual intention of going to the house was well wished on finding out the well-being of the neighbor as opposed to stealing the television set. The intent to still the television set is a key issue to be proven by the prosecution beyond reasonable doubt that the client had an intention of stealing the television set. Read More
