The Ideal Society Introduction The notion of “Ideal Society” refers to such a community wherein the factors such as justice, liberty and peace exist. In this particular society, every individual is treated equally. To establish an ideal society, people need to lead a disciplined life. They have to follow and perform their individual duties cordially in order to create an ideal society. Recently, the conduct of illegal activities has risen extensively as compared to earlier years. This might be because of varied reasons. These reasons can be the increased level of unemployment rate, rising imbalances between wealthier people and the poor ones and prevalence of poverty among others. Thus, in this regard, it can be affirmed that the roles of criminal justice system are also getting extended with the increase in the aforesaid factors (Hargraves, 2006; Davis, 1983). The different factors that are related to an ideal society, which comprise equality, justice and liberty are found to be interrelated with each other. This can be justified with reference to the fact that in order to maintain the balance of equality amid the people in a society, justice plays an indispensable role. In this regard, justice not only tends to punish a culprit but also provides the right judgment to the right one and maintains discipline in a society. Apart from these factors, the role play by the police, respective governments and military also contribute in forming an ideal society. The government, judicial, police and military are regarded as the legal representatives that possess certain constitutional rights (Hargraves, 2006; Davis, 1983). With this concern, the essay intends to discuss about various important aspects that contribute in establishing an ideal society and also a comparison will be made amid these factors to acquire a brief understanding about the current criminal justice system prevailing in a society. Features of Law and Order in an Ideal Society While discussing about the characteristics of law as well as order in an ideal society, it will be vital to mention that the prime intent of law is to keep a particular society running with following certain effective legal guidelines. Specially mentioning, to maintain harmony in a society, both law and order needs to be maintained at the optimum level. To make an ideal society, a society needs to be crime free. Thus, to attain this objective, the notion of criminal law and criminal justice system plays an imperative role. In this modern day context, the main feature of criminal justice system is observed to be prohibiting the conduct of illegal activities in a society. The notion of criminal law is directly related with the activities perform by police. Police often play the imperative role of transforming and executing appropriate law enforcement related policies for the entire public residing in different societies. Amidst varied criminal offences, property infringement is viewed to be one of the major concerns in this present day context in comparison with the previous years (Hargraves, 2006). Thus, based on the above analysis, it can be affirmed that the role play by criminal justice system and the activities perform by police eventually contribute in making an ideal society. After acquiring a brief idea about the role of criminal justice system in prohibiting the conduct of illegal activities in a particular community, it can be ascertained that the aspects like legal supremacy and responsibility of every citizen rely on adhering the norms that formulate by certain regulatory bodies or respective governments of a nation. Moreover, social opinions of the community members and most importantly various developmental approaches also play an imperative role towards establishing an ideal society (Liscombe, 2005). Thus, in order to ensure forming an ideal society and most vitally restricting the conduct of illegal actions, utmost focus must be laid on determining the social securities and identifying the governmental roles among others. Role of Police in the Context of Criminal Justice System While identifying the roles of police in the circumstance of criminal justice system, it will be vital to mention that every individual residing within a particular community must ensure that the notion of justice is delivered appropriately. It is anticipated that this practice will certainly aid in maintaining harmony as well as peace amid the members within a specific community of this present day context. With this concern, it is worth mentioning that the roles of police are identified as the gateway, which aids in curbing all the illegal actions that are performed in a society. It can be apparently observed that the conduct of illegal activities in this contemporary community is incessantly rising. Thus, it is anticipated that there lays an increasing requirement of making extra efforts by the police towards lessening the conduct of crimes from a particular community. Specially mentioning, the distinct roles of police in relation to criminal justice system are apparently noted as making effective decisions about the charges to be filed, gathering necessary evidences and subduing the offenders among others. After acquiring a brief idea about the diverse roles of police, it can be affirmed that in order to run a society ideally, the police need to be corruption free. Moreover, the police needs to be more attentive and remain much cautious about the offence of crime being held or going to be held in a society. In several cases, it can be seen that the police has taken all the powers into their hands for controlling any crucial situation. In the context of criminal justice system, the dominant characteristics of police serve as a deterrent towards the conduct of disorders as well as crimes in a particular society (U.S. Department of Justice, 2003). Thus, based on the above discussion, it can be affirmed that the roles along with the responsibilities of police have raised at large in this present day context due to gaining momentum of the conduct of various illegal activities. Role of Military in Criminal Justice System Another vital attribute, which plays a decisive role in criminal justice system to curb the illegal activities conducted in a society, is military. Notably, its major function is to maintain security in the entire community along with making it terrorism free. In this similar context, it will be vital to mention that trespassing to another country without having any legal consent is duly considered to be the conduct of a big crime. Justifiably, the increasing number of illegal immigrants in any country might generate a chaos in the respective societies in the form of promoting terrorism. Therefore, to establish an ideal society, the aforesaid criminal activities need to be discouraged, which is one of the prime goals of military. In this modern day context, the prime intent of military of every country is to make effective strategies for preserving broader national security and maintain the same. These strategies can be meausred in the form of utilizing the accessible resources efficiently and conducting an operational examination to estimate the powers in protecting a society. For maintaining social balances, the military requires consulting and coordinating with other social welfare services and participating in various campaigns having the theme of making a society chaos free. Apart from the above discussed roles, the military mainly protects a nation by keeping its border safe from the conduct of any terrorism or illegitimate activity (Ghana Armed Forces, 2014). Ideal Functions of Judicial System The major function of judiciary system is identified to govern justice. In the context of criminal justice system, the judiciary bodies play an imperative role towards safeguarding the interests of the individuals residing within a particular society. Notably, there lay certain judicial along with non-judicial functions that are required to be taken into concern for strengthening the system of criminal justice and most vitally for establishing an ideal society. In this similar context, one of the judicial functions is evaluating the facts of any case involved in the conduct of illegal activities prior to going to the court room. On the other hand, determining appropriate and relevant evidences is viewed to be the major non-judicial function, which assists in prohibiting the conduct of unlawful activities in a particular community at large. In this modern day context, wherein the rate of performing illegitimate activities is raising excessively, the role of judiciary system has been extended to apply the actualities of law to specific circumstances after evaluating the facts. It is worth mentioning that in order to make an ideal society, the judiciary system of any community needs to hold the guardianship of any framed constitution. Certain societies may possess several law building and administrative experts who at certain times decipher their respective powers that might generate a great chaos in a society. In the context of criminal justice system, the judiciaries often tend to make deliberate efforts in ending all conflicts and maintaining peace in the society. To make an ideal society, the jurisdiction or the judicial system often plays the role of an advisor (Joshi, 2012). Importance of Land Law in Criminal Justice System The devastation of civic or reserved property by any person is treated to be an offence. Moreover, a property, which has been damaged with a predetermined perspective, is duly considered to be a violent act. Thus, with this concern, the respective governments of any nation are noted to introduce varied sorts of land law in order to prohibit any conduct of illegal activity emerging from violation of land associated rights. The significance of varied land laws can be determined in determining the rights of the investors who invest substantially in properties like land and real estate among others. In an ideal society, it is to be affirmed that the property rights should be respected. People must have the rights to sell properties by following effective legal guidelines without harming any individual. It has been quite apparent that taxes are levied on varied properties with the sole intention of evading the crucial concern of property infringement or land related crime. Specially mentioning, the immigrants who remain continuously involved in trespassing into a country and occupying lands without any legal consent also lay under the dimension of criminal justice system as these are duly considered to be committing criminal actions (Castellino & Keane, 2009). Thus, proper and effective regulation of land laws are regarded as essential elements of criminal justice system that need to be taken into concern in order to form an ideal society. Family Law in Criminal Justice System To create an ideal society, it is mandatory for all the individuals to lead a healthy life. However, in this present day context, it can be found that domestic violence is augmenting rapidly as compared to other social violence. It is worth mentioning that getting humiliated incessantly from the family members is duly considered to be a domestic violence. In an ideal society, effective and relevant laws need to be framed and executed for the purpose of preventing such activities. In the context of criminal justice system, the victims must possess the rights to live with dignity and privacy. In this regard, child abuse can be duly considered as one of the themes based on which several laws have been introduced in diverse nations throughout the globe. Notably, governments of certain countries have introduced varied legislations in order to deal with distinct family or social issues. It is anticipated that the introduction of such laws or lawful regulatory procedures will aid in establishing an ideal society by making a mandate of following such policies and punishing those who violate the same (Stop It Now, 2008). Thus, it can be affirmed that the introduction of varied family or socially issues related laws will significantly aid in developing an ideal society, which in turn, may result in upgrading the system of criminal justice. Conclusion From the above analysis and discussion, it can be comprehended that there are various attributes, which help in creating an ideal community with strong legal system. These attributes can be noted as the introduction of varied regulatory as well as lawful policies, inherent functions of the judicial systems, increased role of police along with military and better utilization of land laws among others. By taking into concern the present day situation of the contemporary world, immense improvements need to be done in the aforesaid attributes. For instance, the police need to be more attentive and active in its respective works with the sole objective of securing the citizens as well as forming an ideal society. Moreover, apart from the above discussed aspect, the police need to more strict towards controlling the big crimes that impose adverse impact on the development of a nation as well as a community. It is worth mentioning that military is recognized as one of the pillars of a country along with its surrounding communities, which protects from any sort of damage make by the outsiders. However, in this regard, the military also must ensure that the nations are secured from any external attack and lay utmost focus on strengthening social along with legal departments at large. It is to be affirmed that justice is generally made for maintaining the regulatory norms of a society. However, certain loopholes can be apparently recognized to remain present in every book of justice, which is a major reason behind the formation of an unsuccessful and unsecured society. Thus, based on these aspects, it can be concluded that the criminal justice system is a branch of criminal law, wherein every individual are well aware about the implications of committing any legal activity and also the legal norms that are applicable with respect to such action.
