Untying the Knot - Case Study Example

The couple. Kate is an impulsive career-oriented woman who is not afraid of risks in whatever decision she might come up to, who happened to be wed to Max, a controlling man who preferred art rather than an increase of salary. It's surprising to know that in eleven years of marriage none of the couples adjusted to one's flaw in order for the marriage to last. Though it seems that Kate did submit herself to her husband's term, it was her character as financially domineering in the marriage that held her back for total submission or to give way.

It always boiled down to financial reasons. Her impulsiveness often resulted in disappointments, and the result of her marriage to Max is a failure as expected. Was the marriage salvageable The former couple (not yet married at that time) was revealed as vacationing at the Costa Rica, where they had a serious argument for looking at different birds in the same tree? This incident depicted the seriousness of their indifferences to prolong being tied in a commitment. It was stated that Max still longed for reconciliation; the only problem is that, lately, they both realized that Kate doesn't want to get married not only to Max but to anybody else.

She longs for freedom and always had preferred it all along unconsciously. Their possible reconciliation is never impossible; yet, it depends upon the willingness of each party, especially in Kate's side. Also, it was stated that during their sessions in mediation, they could always find time to amuse themselves in the humor that just the two of them could share, even not being married to each other anymore. Who was more at fault Kate, during their period of marriage, did her part of being submissive to Max.

On the other hand, Max imposed his own preferences on the relationship regardless of the insensitivity it might appear to her. In the story, it appears that Max is contented with his situation on the commitment of being the income-inferior, not putting himself into the challenge of trailing along with Kate. Yet in the end, it was him demanding higher part in their properties, which technically to Kate were expenses. Also, Max never had the slightest desire to adjust himself in their relationship for the further symbiotic terms.

Sociological insights. Mediation is a voluntary process in which a neutral professional helps separate couples discuss the changes facing them. Options are explored in an effort to reach mutually agreeable solutions. In mediation, one can remain in control of the decisions that are made. Contrary to the more conventional divorce, mediation helps minimize conflict, stress, and disruption. It helps improve communication and understanding, and it is less costly and requires less time than litigation in conventional divorce.

Mediation is a co-operative rather than a competitive process. It gives the couple an opportunity to work out the terms of their separation. It can often save the most time, money, and emotional turmoil observed in divorce trials.
