Formation of a Speech Code - Essay Example

The first amendment gives free will to every individual to speak out and express themself according to the constitution. The speech code does not fall in the category of the first amendment and it can be challenged based on the amendment. The school authorities cannot restrict the students as they have the right to speak whenever they want to and to whoever they want to.
The speech code of the University of Pennsylvania, for instance, is created to protect the wider student community on campus. The code limits speech and conducts when it comes to the rights of other students. No student is allowed to use threats, violence, and hostility against the other. The university provides strict rules against such events and protects students from the discrimination and biases that prevail in the modern globalized world. The disciplining habits and codes of the university mentioned are aimed at preparing students for their future lives. The code of the University of Pennsylvania can undergo a constitutional test and may be pronounced unconstitutional because it does not allow the students to freely speak (Lewin 2003).

My current workplace has a speech code and it is adopted to avoid any kind of hate crimes occurring within the workplace. Before the speech code was implemented the workplace saw many fights happening between the workers. The workplace without a speech code can have several problems because of the minorities participating in the jobs. Blacks are the most targeted in the workplace because of their lower ranks.

Speaking about the minorities openly created fights between these minorities and other workers and the company decided to adopt a speech code so that the violence could be avoided. After the speech code was adopted a great change has been seen all over these years which clearly shows that the speech code is beneficial to the necessary institutions. However, over the years, it has been seen that speech codes in different institutions have been challenged by students and different educational groups. A suit was filed on the speech code adopted by the University of Pennsylvania which was then removed after a legal settlement (Lewin 2003). In my belief speech codes may be unconstitutional but can help a great way to avoid fights between colleagues. My workplace is an excellent example to witness this as previously many fights were witnessed between the workers but after the speech code has been implemented the number of fights has also decreased.
