? Legal aspects of Nursing A registered nurse has the responsibility of providing proficient care to patients. This includes categorizing their roles with management, in addition to identifying and evaluating her dexterities, capabilities and knowledge. Needless to say, offering proficient nursing care also engrosses employing knowledgeable ruling and decision making process. Knowledgeable decision making necessitates the nurse to utilize her dexterities and understanding, in addition to identifying when she requires extra support. A registered nurse is obligated to use her capabilities and decisions to make resolutions on whether to take on responsibilities or whether to assign the responsibility to another person (Florida Department of Health & Florida Board of Nursing, 2007). A certified nurse should offer care and help that are associated to personal care, maintaining mobility, hydration and nutrition, elimination, use of assistive devices, sustaining the environment and resident safety, data gathering, and post mortem care. In addition, a certified nurse should offer care related to identification of and reporting of abnormal resident findings, symptoms and signs, roles associated with end of life care, resident socialization, leisure activities, and legalization methods and realism course. A registered nurse should perform duties associated with basic first aid, emergency care, and CPR abilities, duties associated with documentation of certified nursing services on daily basis (Florida Department of Health & Florida Board of Nursing, 2007). Duties associated with personal care include: dressing, bathing, grooming, shampooing and care of hair, shaving, caring for the skin, feet, and nails, offering and helping with oral hygiene and denture care, offering pericare, sustaining a clean environment, and making a patient’s bed and handling the patient’s linen. The duties associated with sustaining mobility include ambulating, positioning, turning, transporting, lifting and maintaining body position. On the other hand, duties associated with hydration and nutrition includes giving food to patients and helping them with eating, and assisting them to drink as well. The duties of a registered nurse associated with elimination include taking the patient to toilet, helping them use urinal and bed pan, offering catheter care, and bowel and bladder enlightening. In the use of assistive devices, a registered nurse has the responsibility of taking care of eyeglasses and contact lenses, applying braces, antiembolus stockings, wheel chairs and crutches, and using comfort devices such as wedges, pillows, boots and wedges (Florida Department of Health & Florida Board of Nursing, 20007). The Florida nursing practice act has the duty to practice his or her profession stanchly, desist from deliberately taking harmful drugs, and desist from overseeing any injurious drug to patients, sustain and elevate standards of the nursing profession, and maintain any confidential information of patients during the practice. In addition, a registered nurse should assist physicians in their practice, follow instituted nursing procedures, follow the instructions of their supervisors, and advocate for his or her patient (Florida Department of Health & Florida Board of Nursing, 2007). Before being licensed as a nurse, an individual should fill an application form and submit a fee that does not exceed $150 set by the board and an examination fee that does not exceed $75. In addition, the individual should pay applicant cost to the board for the purchase of an examination from the National Council of State Boards of Nursing. Before licensure, an individual should also provide adequate information, which must be presented by the department for a nationwide criminal records correspondence check through the department of law enforcement. Before being licensed, an individual should also be physically and mentally sound. In addition, one should be a holder of a high school diploma, and has accomplished the conditions for graduation from an accepted program. An individual should also have the capability to communicate in English, which is established through an examination administered by the board (Florida Department of Health & Florida Board of Nursing, 2007). In applying and taking the licensure exam, an individual should first apply to the department of health to take the examination. In applying for the examination, an individual should complete the application form and pay a fee set by the board, examination fee, plus an actual per applicant cost to the department for the purchase of the examination. In applying for the examination, one should provide adequate information to be submitted to the law enforcement department for verification of any criminal reports. In addition, an individual should prove that they are physically and mentally sound, and should submit their education credentials. In addition, an individual should prove to the board that she can communicate in English language (Florida Department of Health & Florida Board of Nursing, 2007). After taking the examination, if the applicant passes and provides evidence of satisfying the academic conditions stipulated by the board, she or he shall be entitled a license as a registered professional nurse. Any applicant who fails the assessment three successive times, irrespective of the influence in which the examination is taken, shall be obligated to accomplish a board-accepted remedial course before being permitted to redo the examination. After being granted the remedial course, an individual may be permitted to retake the examination up to three times before being allowed to retake a remedial examination. After this, the individual will be obligated to apply for re-examination within 6 months after accomplishment of the remedial examination (Florida Department of Health & Florida Board of Nursing, 2007). Before a registered nurse from Georgia can be registered in Florida, he or she has to apply to the department and remit a fee set by the board and does not exceed $100, one has also to show the board that he or she holds a legitimate license to practice professional nursing in Georgia, an individual should also show that he or she has met the requirements of licensure such as good English command, he or she should show that they aggressively practiced nursing in Georgia state for two of the previous years without his or her license being affected by the licensing authority. In addition, the applicant should provide adequate documents that would be submitted at the department of law enforcement to determine any criminal records (Florida Department of Health & Florida Board of Nursing, 2007). A registered nurse should retain certificates of attendance and other documents for four years to document the completion of the continuing condition. A Florida-registered nurse operates under a 2 year restitution phase and must accomplish 24 hours of apposite training all through each restitution phase. The nurse is required to undergo one contact hour every month during the licensure phase, plus additional two hours on avoidance of medical mistakes. HIV/AIDS education has become one of the requirements for renewal of license, where an individual is required to have a one hour training accomplished before the restitution. Domestic aggression is also another prerequisite, with the applicant required to complete 2 hour training before renewal (Florida Department of Health & Florida Board of Nursing, 2007). Advanced Practice Nurses are licensed nurses with higher education, certification and clinical training, and serves as health care providers in a wide range of primary care, outpatient settings and acute care. An advanced practice nurse has the duty to offer preventive management and care of acute and chronic diseases using the enhanced capabilities, therapeutic interventions and diagnostic reasoning. An advanced practice nurse should examine a patient’s health condition through inclusive physical evaluations, health histories and construed diagnostic examinations. He or she should formulate diagnoses and come up with s treatment schedule to control health problems, avert disabilities, enhance health sustainability and optimize functional abilities. In addition, an advanced practice nurse should prescribe, order and adopt treatment and interventions identified in the treatment schedule. An advanced practice nurse should also examine progress documents of a patient towards achievement of anticipated results and offer confabulation to other providers to maximize the plan of care and institute system modification (Florida Department of Health & Florida Board of Nursing, 2007). An individual violates Florida’s nursing practice act if he or she practices professional or practical nursing without holding a license or a certificate. In addition, an individual also violates the act by continuing to use a certificate or license that has been revoked, consciously employs unlicensed individuals in the practice of nursing, and if an individual obtains or tries to obtain a license through false pretense or misleading information (Florida Department of Health & Florida Board of Nursing, 2007). Disciplinary actions may be taken against an individual if he or she attempts to purchase a license and renewal of licenses through bribery or misrepresentation, if the license is revoked, and for being found guilty of or entering a plea of nolo contendere to, irrespective of arbitration, an offense which associates to the practice of nursing. Disciplinary actions may also be taken against an individual for theft, robbery, fraudulent acts, indecent exposure, assault, child abuse and neglect and exploitation. Disciplinary action can also be taken against a person who files false reports, engages in unprofessional conduct and is fined an amount that does not exceed $150 for each account of offense (Florida Department of Health & Florida Board of Nursing, 2007). Disciplinary actions can be taken against an individual for filling a false report only when the he or she was aware that it was false, and intentionally filled the report needed by state or federal law, deliberately hampering such filling or making some else to do it. In addition, when one is found guilty of, irrespective of the arbitration, or entered into a plea of nolo contendere or guilty to, offenses that have been stipulated by the act. Disciplinary action can also be taken against a registered nurse when he or she engages in the sale, possession or the distribution of controlled items as set forth in chapter 893. Inability to practice nursing with acceptable skill and care to patients because of illness or due to the influence of alcohol, narcotics and drugs or any other chemical that may impair physical and mental activity may amount to disciplinary actions taken against the nurse (Florida Department of Health & Florida Board of Nursing, 2007).
