Carol recovered from the snake bite, but lost her baby which died as a result of the poison entering Carol's system. Having established the criteria needed for such charges to be brought it will be then necessary to discuss any possible defences that each might have. In order to determine what Richard might be charged with it is necessary to consider the level of the assault and then the actus reus and mens rea required to prove the offence.
