It is the process in which a woman carries pregnancy for another woman and gives birth to a baby for her. The process of surrogacy is gaining popularity now-a-days at a very fast pace with the advancement of technologies and unregulated legal system. It is becoming the only way to adopt a child for several couples in different countries for the adoption of their own child though it may be a long drawn process. Surrogacy can be carried out in mainly two broad ways i.e. gestational surrogacy and Traditional surrogacy (Surrogacy UK, 7). This surrogacy is advised to the people who are either having medical problems or due to premature ovarian failure or have the risk in pregnancy and would be life threatening and don’t have any chance in future. But with this new concept of adopting a child there are several consequences of problems which arises for misuse of the practice and loosely regulated legislative. In several countries like France, Japan, Netherland and Greece and also few states of U.S along with the District of Columbia the practice of surrogacy is not permitted by the government. Countries like India, Ukraine, and Georgia are few who permit the practice and with the low cost adoption process India is gaining huge popularity from the foreigners specially Asians staying at UK. But this growing demand of surrogacy in India can sometimes lead to false practices and may lead to business process for some to take the emotional advantages of the society and cultural regulations. Thus in order to carry out the practice in a fair manner the government should take steps to regulate the bodies operating in the following industry and the operating bodies should also have their own ethics and moral which should not harm the community r countries cultural values. Problems arising from the different issues The process of adoption is not a very easy process in surrogacy cases. There are various constraints which are needed to be taken care of before carrying out the practices. These issues are needed to be very well evaluated beforehand otherwise this might lead to several other issues in particular countries and even may indulge some people to adopt unfair means of carrying out business taking the advantage of the sensitive side of the process. The payment should not be the reason for being the surrogate mother for any couple who want to adopt. There are some problems which arise regarding the citizenship of the child which are not controlled by the parents or clinics. Thus a regulatory body is required who can ease the process of legal transfer of papers for citizenship like in India few clinics have their association with Japanese Agencies who work for the assist of surrogacy in India for baby’s Japanese biological father. Under proper jurisdiction and restricted practices the process should be conducted otherwise false practice can be dangerous for the society. All the countries should look into the practice in a serious way and should facilitate the process so that pressure and demand on specific country don’t results in irregular and erroneous services from the clinics. Commercialization of the service without proper evaluation of the infrastructures available can be threat for the pregnant woman. New technological advancements should be used for the betterment of the process of surrogacy and investigation of the regulatory body for the complicated practices is required to carry out the process in an appropriate manner. Though with strict regulatory body the practices can be carried out safely and ethically but several other consequences may arise from the faulty practices for the sake of business in several countries including India. Several cases of allegation from the parents came about the raise of fees from the doctors just after the birth as the clinics know that there is an emotional attachment in the issue s the parents will be ready to pay for any reason. This should not be carried out by the authority itself to earn extra money from this business. Surrogacy must be restricted to the people who don’t have any other option than adopting child from this process due to health problems but it must not be a process of adoption that are not eager to be pregnant and want to fill the gap in their life by this means. Surrogacy should not be a process of baby selling rather the clinics should keep in mind it’s a process of adoption in a legal manner (Gostin, 131). With the use of proper technology and identifying the customers need, promoting the service in an ethical manner under strict regulation and legislature the business of medical tourism should be carried out for the betterment of the society.
