What has consolidated what you already knew about The Family & Family Law? Family law is sometimes known as the matrimonial law and is fundamentally a law area that revolves around family matters as well as domestic relations such as marriage, domestic partnership, civil unions, adoption and surrogacy, relationship termination and ancillary issues such as divorce, property settlement, child custody, visitation, child support annulment, and alimony awards. Other issues of family law may also include juvenile adjudication, paternity fraud and paternity testing. However, family matters varies depending on the jurisdiction. For instance, in many jurisdictions based in Western Australia, family courts deal with most crowded dockets with litigants acting as representatives of all economic and social classes within the family justice system 2. What has changed your opinion after studying this unit, and why? The issue of Gay and lesbianism can be a very challenging task especially when it comes to its social, physiological, psychological and religious implications. Generally my view on lesbian and gay parents has changed owing to the fact that children raised by the so called blended families have no major differences as compared to the other children raised by heterosexual parents. In fact, those children raised by heterosexual parents are more likely to be molested by their close relatives as compared to those raised by homosexual parents. 3. What would you see as the most challenging psychological aspect of Family Law? The most challenging psychological aspect is having to deal with the fact that one of your close relatives is suffering from Delirium or any other mental illness. Additionally, the sight of seeing someone you love suffering from mental illness may cause serious stress, confusion, sadness, anger or fear for their well-being. Additionally, as far as children and siblings are concerned many of them may develop stigma, they may experience a family life that dwells around their sibling mental illness, they may also experience survivor’s guilt or personal shame since they are doing well and healthy which is not the case with their sibling. 4. What would you see as the most challenging legal aspect in the future of Family Law? The Mia act in Western Australia is one of the most challenging legal act that needs to be revised in the future if not sooner. In other words, the MIA Act has been criticized in Australia for permitting individuals to be detained due to the fact that they are mentally unhealthy to stand for trial or rather not guilty based on the account of not being of sound mind. Moreover, by so doing, it will ensure that any existing differences in individual’s treatment revolve around a sound policy rather than legal inconsistency or oversight. Therefore, it is high time that the Australian laws have to be re-thought as far as protecting the mentally unsound is concerned. 5. What would you see as the most challenging social aspect in the future of Family Law? Social challenges faced by families of those who are in prison is worse compared to economic challenges because some of the social challenges do not have readily available solutions. Social challenges are always inward and emotional, which may take time to heal. There are instances where family members of prisoners commit suicide or end up with mental case because of the inability to solve the social and emotional challenges that they go through. The most affected are new married couples who can no longer share the intimacy they craved for when they were getting married. Therefore, social challenges as far as prisoner families are concerned are one of the most challenging social factor in the future of family law. Read More
