The grounds of issuing warrants are set and explained fully in the constitution so as not to infringe the rights of individuals. A search warrant is all an officer requires to enter a person’s garage with which he/she has reasonable doubt of the impending danger that might present. This is presented to the owner of the property to give notice of the reason for the search. Arresting a suspect on probable cause prompts the officer to have an arrest warrant issued on the person for previous crimes.
An arrest warrant is issued after a legal complaint has been placed on the suspect in an enforcement agency such as the police station (Del Carmen, 2006). Remarkably, it does imply that the suspect is the criminal but it usually gives the enforcement agency a couple of hours to investigate the issue in detail before filing legal case on the suspect in the court of law. The issuance of warrants gives way for effective and efficient investigation to be conducted and streamlines the process of enforcement.
Since enforcing the law is faced with difficulties such as wrongful accusations and suspects tampering with the investigations, warrants ensure that these difficulties are avoided. Enforcing the law requires deep comprehension of the law and rights of each person as well as cognitive awareness. A police officer is not just supposed to understand the law but also interpret it. The roles that come with being a police officer give them the ability to make quick rational judgments depending on the situation they are faced with.
For example, when issuing a search warrant and the suspect starts running or shooting at the police at the first moment of sight, this brings into play the interpretation of the law. Search warrants could be foregone when the situation calls for hot pursuit due to the suspect’s retaliation.
