Garcia V. Becker Bros. Steel Co. (2011), the defendant of this case, Bros steel company bought a slitter line 1973 for use in their steel business. Shama LLC purchased the equipment and a tension stand to enhance its performance. In the case, the plaintiff sued the original owner of the machine for negligence that resulted in his injuries. The basis of this case was the fact that Shama LLC made new modification to the original equipment without informing him. However, the original owner claimed that he owed no duty to the plaintiff’s employer.

Ethical Issue Dimension of the CaseThe case raises the significance of work ethics and employee legislations in ensuring the health of employees. In addition, the case indicates a conflict between ethics and laws (Brayne 23). Work place ethics are based on the accepted codes of conduct within an organization. Thus, each profession has its own ethics that are supposed to be observed by all members of that particular profession. For instance, the engineering and construction has its own professional codes of ethics.

All members of the National Society of Professional Engineers are expected to observe these ethics. Employee’s Safety is a major aspect of the ethics. This is because workers in this sector deals with dangerous machines and equipments. In addition, people are expected to consider the safety of other workers as they consider their own safety (Gray 78). If steel and Bros Company valued this code of ethics, they could have informed Shama LLC about the modification they carried out on the slighter.

In addition, the company needs to have prepared a new manual that indicates the safety regulation for the modified machine. The failure of Shama LLC to indicate the modifications done on the slighter is a mistake that they ought to be responsible. It is therefore ethical for Shama LLC to compensate Garcia. However, the company uses the law to legitimize its failure to meet its obligations and compensation of the victim. Case ResolutionThe California court of appeal ruled out that Becker Bros.

steel and Shama LLC are separate entities. In addition, all components of the machine were the property of the current employer. This indicates that Shama LLC was responsible for all liabilities resulting from their newly acquired machines. In addition, the company was required to have an insurance scheme to compensate its workers. The court ruled out that Shama LLC was responsible for the health of its workers. In addition, the court ruled out that the Becker bros steel company was not legally responsible for the injuries suffered by the plaintiff.

Shama LLC was therefore required to compensate Garcia for the injuries caused by the machine.Administrators Actions to Mitigate Future Issue Escalation and ReoccurrenceThe legal system of a country has the responsibility of protecting the health of workers. However, due to lack of appropriate legal structures, most employers fail to prioritize the health of their workers. In addition, employers also fail to compensate their workers for injuries resulting during their work. This indicates that the judicial system require setting up structures that would ensure that employers are legally accountable for the health of their workers (Frey 78).

Other than legal framework and structures to compensate victims of work pace injuries, administrators need to consider the effectiveness of work place ethics in order to prevent future occurrences. In most cases, work place ethics lack effectiveness due to lack of legal support. Thus, administrators of workers unions need to link workplace ethics with the country’s legal structures. This indicates that ethical codes of practice will have a legal backup that will facilitate the prosecution of offenders.

In addition, administrators need to redefine workplace ethics in order to incorporate different controversial issues. Issues related to health of employees and transfers of ownership and liability are some of the factors that need to be redefined. ConclusionThe Garcia V. Becker Bros. Steel Co. (2011) is a recent case that indicates the controversy surrounding the legal and ethical frameworks in organization. The case depicts the controversies that surround cases related to public health and contractual responsibilities (Slorach 78).

According the verdict of the case, workers are vulnerable to complicated contractual laws. The case also depicts the inability of professional ethics in ensuring the safety of workers (Mulcahy 67).
