It will be hard for John to make the right decision because he is a father of two children. He will be filled with empathy for the affected parents and will more than likely find the accused guilty as a way of compensation for the parents. He will put himself into the parents’ shoes and assume that he has lost a child. This will automatically cloud his judgment and he will conclude the criminal is guilty even when he/she is not.
I. Civil suits involve private disputing parties, for example two business persons who are in conflict due to a breached contract; while Criminal suits involve criminal activities that are considered harmful to the society, case in point, murder.
II. In Civil cases, a Plaintiff sues the Defendant for damages and may ask for compensation from the other party. On the other hand, Criminal cases involve a formal document for the accused known as an Indictment. The victims are not involved in taking the matters to court, the government shoulders this burden for them.
