Either the seller or the manufacturer dictates the extent to which warranties apply” (Christensen, 2003) Warranty is an obligation to the consumer from the seller. It is through the warranty terms the seller ensures the quality and reliability of the product to the consumer. Warranty guards the consumer from any kind of cheating from the seller. It also ensures the proper service or maintenance of the product if required. It is similar to guarantees, because of the legally binding assurance it provide to the customer.

“However, unlike guarantees, the customer normally pays for this extra protection.” (Returns and refunds, warranties and complaints) For example, because of natural calamities like thunder or lightning, if the electric or electronic product spoiled, it is the duty of the supplier to repair it by taking only the costs of the parts replaced. If the product is guaranteed against natural calamities by the supplier, then it is his duty to replace the damaged product with a new one. A supplier cannot, for instance, refuse to deal with a customers complaint about a faulty product simply on the grounds that the warranty on the product has expired.

He cannot argue that he is helpless because of the expiry of the warranty. “A condition is a term (oral or written) which goes directly to the root of the contract, or is so essential to its very nature that if it is broken the innocent party can treat the contract as discharged. That party will not therefore be bound to do anything further under that contract.
