The remains were scarred beyond recognition, and the argument was made that there was not even a way to determine how long the remains had been buried, thereby negating the opportunity for the defense to prove that Lewis could not have been the one that murdered the victim.

Upon appeal, the Appellate Court sided with the state’s argument that it did not matter whether or not they failed to produce and identify the actual body.
