…and some reflections

Many thanks to my teachers for granting me their time, help, and ongoing encouragement. This help has been invaluable to me and has made the dissertation journey a much more enjoyable and didactic experience.

A few years ago, little did I know that my incentives to undertake intellectual property law in the first instance based on my penchant for learning would patent themselves in with my personal vocation of working for the entertainment industry. The fundamental reason for choosing this topic was that having searched literature I found that very few works had been conducted with regards to Intellectual property issues in cyberspace. Some of the limitations to my study became obvious to me during my research. Managing time during this hectic academic year was tough as I am one of those people who nurture a strong ambition to make my way to the top. The organization is a keyword in my personal, social, academic, and professional life and I firmly believe that organization makes any business entrepreneur succeed like success. I have made this vital principle the guiding star of my life and so for this dissertation. I believe that harmony with my colleagues at work and class-fellows and schoolteachers can work wonders in the efficient achievement of group tasks. Last but not least I tried to keep focused. This is partly due to my family-oriented lifestyle and fatigue from my job which I need to finance the running expenditure of my further studies.

Abstract
The copyright industries themselves have responded with new business strategies by providing legal download services. The internet has been famously defined as a network of networks, and the denser these networks become; the more complicated it becomes to prevent the bane of copyright infringement and other intellectual property violations from occurring. Even though the courts have been willing to intervene where there has been an infringement of copyright, the practical difficulties of managing copyright violations arise whenever the “sheer scale” and “speed” of the internet causes high-speed reproduction of the material to be achieved without actually being detected. This dissertation will also touch briefly on the related matter of domain name disputes and trademark infringements in cyberspace particularly with the inception of the “Second Life” initiatives. Also involved is a discussion of fair use and other IP issues

Introduction
Chapter 1
"We sit on the edge of a cliff, where radical new technology is rising up to us with a force so powerful that it will transform our landscape. The rules of commerce are shifting rapidly, with explosive new business models taking shape by the minute. Almost every day we are astounded by the latest innovation in communications, computers, and biotech. Technology is behind key transitions in the very foundations of our society."

James Canton, Futurist.
1.1 Introduction to Intellectual Property Law and the related issues of Internet IP infringement
This section discusses the “challenge of balancing competing interests” in the context of Intellectual property Law on the internet. It is worth noting at the outset that things get complicated when the problem of IP infringement crosses borders and it is at this point that the international legal framework comes into play. So when there is a mention of IP law there is a discussion of the international and EU-based legal framework as well as the local laws of England. Whereas the aim of my thesis is to draw upon examples from all times of IP rights and infringements on the internet, in this vein throughout my dissertation there will a heightened emphasis upon the recent developments in the area of Copyrights and Patents law mainly because of the interesting legal and economic issues that have emerged in this area in the yesteryears.

1.2 The theoretical premise of Property rights
An understanding of the philosophical premises behind Property rights is necessary for the understanding of the tug of war between the owners and the users of intangible information.
