The employer could have resolved the issue with continuous negotiations with the union and employees while resolving the financial exigencies as well. According to Article 11, the employer is an obligation to provide health care service as per the contract and has thus violated Article 11.3) Yes. The employer violated Article 11 because it is clearly mentioned in the article that employees shall be enrolled in the Select Blue/Point of Service Plan with the common provider directory of Ohio and Pennsylvania physicians and hospitals.

Further, employees will have a $10 co-payment for a visit and a $10 co-payment for a prescription. The argument of the union stating that the benefits under the Health America plan were fewer as compared to that of the Select Blue plan and costs were higher too makes it clear that the employer had violated article 11. Even though the grievance was not timely, the employer could not step over the contract under Article 11 meant for the welfare of the employees. Under the above circumstances, as an arbitrator, I would order the employer to roll back to the previous plan or amend the plan with Health America on the line of Article 11 so that its financial problems are also sorted out.

I would order the employer to reinstate all the employees and provide them with the proper and appropriate health insurance under Article 11.
