However, Supreme Court decisions over the years have established that the right to privacy is a basic human right, and as such is protected by virtue of the 9th Amendment. The right to privacy has come to the public's attention via several controversial Supreme Court rulings, including several dealing with contraception (the Griswold and Eisenstadt cases), interracial marriage (the Loving case), and abortion (the well-known Roe v Wade case).

In addition, it is said that a right to privacy is inherent in many of the amendments in the Bill of Rights, such as the 3rd, the 4th's search and seizure limits, and the 5th's self-incrimination limit". Although the right to privacy is not specifically stated in the text of the Constitution, the 14th, 1st, 4th, and 5th Amendments have provided some privacy protection. The right to privacy protects individuals from information that is gathered, collected, and how the information is used.

 Individuals have the freedom to decide whether or not to participate in certain acts or to subject himself/herself to certain situations and experiences. This right of privacy is protected by the 14th Amendment. Unauthorized use of an individual's name or likeness is protected by the Right of Publicity. For commercial reasons and purposes, this gives an individual the right to license the use of their identity. There are four invasion types of invasion of privacy, according to The Restatement Second of Torts.

These include an appropriation of name or likeness, intrusion, unreasonable publicity, and false light.
