There are other cases where the person causing damage remains liable to the victim regardless of whether they intended to cause harm. These constitute to strict liability cases. A country’s court has many cases to handle ranging from criminal cases to civil cases, among many others. Among the many cases the court handles are tort cases. The court seeks to administer justice to those involved through compensation as well as they look for ways of deterring further occurrence of torts (Best and David 8). Sometimes, compensation for losses incurred becomes the core function of tort law, and contributes to its development. Although the primary function of tort law can be described as the need to determine the required compensation. However, prevention and punishment measures too are important factors that help prevent further tort cases. This is because as the court looks for compensation of the injured, it also looks to send a warning to the offender. When a court makes its decisions on the case and defendants understand they may have liability in the case, it may act as a deterrent measure on further tort cases. However, research shows that goals of compensation and deterrence of future damage may differ in some cases as the court may favor one side than the other (Best and David 8). When courts in the U.S started undertaking tort cases, they considered compensation and deterrence as the main goals of concern. However, compensation became easier to perceive than deterrence and courts expanded tort law focusing on compensation. Later, economic hardships that hit the country largely affected the court's decision to follow compensation (Best and David 9). Impact of legal issues on economy Economic analysis of...
The social cost incurred from the accident is the cumulative precaution and the cost of the expected accident, and becomes what the society is liable for. Economically, for the society to reduce the costs of an accident they should take a precaution that lies in between two extremes; the cost of the precaution itself and the cost of the expected accident (Mattiacci 5).The in-between precaution is the optimal care the society takes because it reduces the cost of the precaution and the expected accident cost thus minimizing the social cost.
Therefore, decisions made by the tort law system should ensure that the incentives they give to the injurer to avoid the accident should enable them take an in-between precaution. The legal issues existing in tort law systems include giving parties incentives to acquire information on the accident occurrence. The court authority should ensure that incentives given for accessing information about the accident should not constrain the economy. This in one way relieves the country economic pressures.
To minimize spending on risks, the tort law system should ensure a most favorable allocation of risks between the injurer and the victim, and it can only achieve this goal through insurance (Shavell 188). On the side of the transaction costs, the tort system’s goal is to minimize the administrative costs that result from the system’s attorney’s and magistrate’s payment. However there is conflict between the distinction on allocations of incentives towards the prevention or precautions taken or compensation for the accident. Acquiring equilibrium between the injurer and the victim will help achieve the social goal of compensation and deterrence and minimize cost on economy. ...Download file to see next pages Read More

... restaurants to Indian local palates (Bellman, 2009). Analysis of the situation With the continued globalization of world markets, firms are ever more dependent on new products to generate revenues and market share. To maintain their momentum and relative position firms must enter a broader and more diverse set of markets (Yeniturt & Townsend, 2003). This could be one of the reasons why McDonalds had to get into the Indian market. Some scholars argue that globalization has progressively created a more homogenized world market due to better interconnectedness among the world’s nations (Yeniturt & Townsend, 2003). This implies that an increasing number of consumers from diverse geographic locations and cultural backgrounds are beginning...

The opinion of economists have varied on this issue regarding the considerable of the GDP is the appropriate measure to understand the well-being of the nation. While most of the economists have relied on this economic indicator as the main determinant of the standard of living, the others have differed stating that the other intangible and tangible factors like education, health as well as ecological environment to be important factors as well. ... didn't know that a man-made landscape could be considered a living organism until Jacobs made the reference to a city being a kind of ecosystem. Everything needs to be balanced and in harmony for all of the occupants to survive in such a fragile place. Nothing makes you think "city" more than the idea of the sidewalk, which is the pedestrian's portion of a city street. Investigating the sidewalk is surely an essential component to gaining an understanding of any urban community. In a crowded city filled with businesses, municipal structures, and parked cars these are just about the only public spaces left for people to spend their time. A safe place to walk is only one of the many functions that the sidewalk fills in a typical city...

... The ethical response to a Child Outlier Introduction If I had a son with a special gift like Josh Waitskin, I would help him develop his special innate gift. I believe it is morally ethical for parents to encourage their children to develop the innate gifts at an early age. By doing so, it would serve the greater society and do justice to the child. I believe that children lack well developed cognitive skills to exercise their individual right to choice thus it is justified to encourage the child to develop the innate gift. I believe that parents should support their children in developing the innate abilities by exposing them to opportunities. Parents should show their children the value of improving the innate talents... The ethical...

August Wilson as One of the Greatest African American Playwrights

Born in 1945, August Wilson was raised in Pittsburg, Pennsylvania. He lived in a two-room apartment behind a grocery store on Bedford Avenue. Being raised in a time of segregation, then coming of age in the era of the Civil Rights Movements must have affected him deeply. Just from reading Ma Rainey’s Black Bottom, the reader can see the racial oppression Mr Wilson must have felt throughout his life being an African American male.

Internationalisation Benefits No-One Other than a Few Rich Shareholders

Internationalization is the modern incorporation of the concept of free trade. It is the process whereby trade in goods and services (also involving free capital flow and transfer of technology) is carried on between countries so that there is an ultimate creation of interdependence between the nations of the world. The main aims of Internationalisation are to expand sales, acquire resources like technology and information, and to minimize business risks.   There is a strong notion that Internationalisation benefits only a few rich shareholders and that it does not very much benefit other stakeholders. The notion is controversial, as there are indications that Internationalisation does, in fact, benefit other stakeholders as...

Garcia Marquezs One Hundred Years of Solitude

The dividing line between contrasting features cannot be drawn as it was the author’s intention to present reality through magical happenings and incredible events.

Marquez’s novel refers to magical realism which is ‘a mode of narration that naturalizes the supernatural, that is to say, a mode in which real and fantastic, natural and supernatural, are coherently represented in a state of rigorous equivalence – neither has a greater claim to truth or referentiality’.2

The author tries to delete the demarcation line between reality and imagination, history and myth. The line between reality and fantasy is intentionally blurred. That’s why attempting to separate re...

Psychology of Learning for Instruction

Swiss psychologist Jean Piaget (1896- 1980) and Russian psychologist Lev Vygotsky (1896-1934) have developed their ideas and theories on cognitive development and psychology that bears a relationship, which is significantly similar, yet essentially different. It is in this context, that Vygotsky’s theory of cognitive development assumes significance. Though Vygotsky and Piaget, agree on certain fundamental aspects of cognitive development, the framework and approach of their theories, differ essentially.
Before a comparative study of two theories could be done, an understanding of the basic tenets of each theory is vital. According to Piaget's theory (1970), cognitive development of an individual occurs through a number...

Globalization and Terrorism - the Two Sides of One Coin

Interacting with persons of vastly dissimilar societal backgrounds has become commonplace and necessary. This has opened the doorway of all nations for members of terrorist groups, who openly despise Western cultures, to infiltrate which has lead to mortally dangerous and economically disastrous consequences. Terrorist acts in a particular country affect the people and property of that nation but severely threatens the economic prosperity of all nations in this inter-connected world. This discussion examines the paradox of globalization, that it supplies both the vehicle and justification for terrorist’s actions. The fear of terrorism is one of personal safety for the average person but, arguably, the greatest threat is fina...

Plato as One of Historys Greatest Contributors

... Pla One of History’s Greatest Contributors The dictionary typically defines philosophy as “the love of or search for wisdom or knowledge” or “as the theory or logical analysis of the principles underlying conduct, thought, knowledge and the nature of the universe” (Neufeldt, Goralnik, 1994, p. 1015). With such a general definition, one might begin to understand the complexities involved in studying philosophy as it seems to encompass just about all knowledge pursuits. Perhaps part of the confusion in trying to define the term can be found in the early days of the science when it applied almost universally to all avenues of knowledge in ancient Greece. The term itself derives from an ancient Greek word that translates to “love of wisdom...

Can One Person Make a Difference in an Organization

Each individual has something to contribute but at times one person can make a difference to an organization.
Technology today has made it possible to retain and conserve knowledge and transmit it to other people in an organization. The knowledge that has been created by a single individual can be a powerful weapon when retained, transmitted, disseminated and applied. According to Nonaka, new knowledge begins with an individual (Chaston, Badger & Sadler-Smith, 1999). When the new knowledge is generated it is merged with the existing knowledge and new knowledge from other sources and provides the basis for new products and processes. Thus knowledge has been classified into two categories – explicit and tacit. Explici...
