  • Common Law :

The common law of any country refers to the set of rules developed by the mutual decision of the courts and the tribunals that constitutes a legal system.

The judges create and redefine the common law, the law is applied in the way that if a case is pending its decision its decisions are dependent on the earlier cases and pave the way for future laws. When there is no specific law already existing, judges are the authority and have the duty to make the law accordingly according to precedent, the precedent’s body is called the common law and it further relates to future laws. However, as compared to the idealized systems, the common laws are a little more complicated. Within some jurisdictions, some courts have more authority over others. However, the common law is commonly in use.

  • The law of Australia:

Australian common law constitutes the law of Australia, and the Australian common law is built based on English common law. Australian common law constitutes the federal laws being enforced by the parliaments of Australia, and other laws by the Australian states and Territories’ Parliaments. The bases for the government of Australia are formed by Australia’s system of constitutional monarchy, described by the constitution of Australia which is the most important law of Australia.
