Canada Privacy Act and USA Patriot Act Canada Privacy Act and USA Patriot Act Canada’s Privacy Act applies to companies in the private sector that operate in the following provinces of Canada:i. Manitobaii. New Brunswickiii. Newfoundland and Labradoriv. Northwest Territoriesv. Nova Scotiavi. Nunavutvii. Ontarioviii. Prince Edward Islandix. Saskatchewanx. Yukon However, the Canada Privacy Act does not apply to these organizations’ management of employee data. This legislation also applies to companies in Canada’s private sector that carry out operations within Canada when the personal data they gather, utilize, or release goes beyond provincial or national boundaries.

However, similar to the first set of organizations, this act is not applicable to organizations in the second set that deal with employee data. Lastly, the Canada Privacy Act applies to federally controlled firms that conduct commercial operations like banking, commercial flying, communications, and broadcasting within Canada. Unlike the first two sets of companies, this law applies to organizations in the third set that also deal with heath data about their employees (Baker, et al., n.d.). Relatively similar to the Canada Privacy Act, the USA Patriot Act is applicable to organizations mostly but headquartered in the United States.

However, this legislation applies to these organizations’ operations in all fifty states and internationally (Minister of Justice, 1985). More specifically, the USA Patriot Act is applicable to “financial institutions” that widely comprise:i. United States depository organizations,ii. credit card issuers and handlers,iii. credit mergers,iv. agents and traders of securities and options,v. currency traders,vi. futures commission businesspersons,vii. investment bankers,viii. insurers,ix. loan and finance organizations,x.
