The court made an injunction that it was not published or cited class action waiver during the contract agreement thus, the claimant signed a cellular telephone service agreement with  T--Mobile admitting that they had reviewed the terms and conditions. Following was the class waiver which the plaintiff precluded it was included in the terms and conditions making it difficult for the court to make the judgment hence T-Mobile is supposed to compensate the arbitrator’s fees (Gaylord, 23).

Decision and Remedy: The court held that the service contract was procedurally unconscionable breached thus, the class action waiver provision was entirely disclosed hence, a  difference in negotiation powers in the absence of a significant alternative made it possible for the plaintiff to acquire a mobile service provider from two providers unlike in the class action waiver clause (Rodger, 14).
