Issue: Was it right for Merrill Lynch & Company to compensate the 700 black brokers when George McReynolds filed a lawsuit about discrimination?

Employees relationship
There are two employee’s relationships. The first one is fixed term and the second one is part-time and casual employees. Fixed-term employees normally have a defined period to work unless otherwise. The working terms are supposed to be explained at the beginning of the work and placed in a written agreement. Conversely, part-time and casual employees normally have rights that are similar to fixed-term employees. Despite the equal treatment their sick, bereavement and annual holidays leave, may differ (Secunda & Hirsch, 2010).

The associated legal consideration
The legal considerations of employees in a business setting can be categorized into two. The first category is entitlements and minimum pay received. The second one is how employers treat employees in their place of work. The law entitles the employees to nothing less than their minimum rights. The minimum rights include health and safety, minimum pay, break entitlements, annual holidays, leave and other holidays, payment for other holidays and leave, and public holidays. Besides, they are also entitled to sick, bereavement and parental leave, flexible working plans, equal pay and rights, and union membership rights (MBIE, 2014).

The types of discrimination issues
There are different discrimination issues and they include age, disability, equal compensation or pay, genetic information, harassment, national origin, and pregnancy. In addition, there are race or color, retaliation, religion, sex and sexual harassment (EOCC, 2015).

The associated legal consideration
In America, discrimination laws are the employment discrimination laws and the 5th and 14th Amendments of the U. S Constitution. In addition, there is Title VII of the Civil Rights Act of 1964; The Age Discrimination in Employment Act (ADEA); The American with Disabilities Act (ADA); Equal Pay Act, The Equal Opportunity Employment Commission and the State Statutes (USLegal, 2015).
