? Obama and the historical Left Wing attacks on 2nd Amendment rights Introduction The 2nd Amendment rights talks on the bill of rights. It allows the people of the United States the right to keep and bear their own arms. This right is not to be infringed by Congress or any government administration. The establishment of the amendment recognized that the government could not dictate on the people’s rights. In addition, the individual freedom and security provision for liberty and life was recognized when the amendment was passed. The paper looks at the historical attacks on the 2nd Amendment rights by the Democratic Party and the administration of the past leadership up to the current Obama administration. In addition, the paper also has details on the role of the Supreme Court and effects of Obama reelection on the status of the Second Amendment1. The individualism of the Second Amendment has what has brought the modern debate on the issue of owning arms and guns. The State is recognized as supreme and individuals that exist are there to serve the State. Therefore, these freedoms are granted by the State, which act as a protector and provider for individuals and groups. The Democratic Party from the Clinton administration up to the current Obama’s administration has had several attacks on the second amendment. The Clinton administration officials and Obama Attorney General co signed an amicus succinct in the District of Columbia v. Heller. The brief signed was in support of DC’s ban on all hand guns. In addition, the ban was on any use of firearm for self defense at the homes. In the brief, it was argued that the second amendment was a united right, instead of, an individual right. However, the modern day freedom patriots and founders of America saw it differently. The amendment was not put to protect hunters and sportsmen2. The amendment was to protect the individual right of freedom, and further, it was to protect an individual from a dictatorial State. More guns are needed in the communities since citizens ought to be armed and taught how to use the weapons for the nation to be free. However, the obstacle to this objective is the Constitutional right of the American people to bear and keep arms. The keeping of the arms can prevent the government from oppressing the citizens. This is because people will have the guns at their disposal any time the government tries to oppress them. The solution to the gun problem lies in the implementation of the constitution. The ownership of the arms is to be restricted with legislation. The government is trying to replace the 20,000 federal, local, and state gun laws. This is done by prohibiting or controlling of arms with laws3. The second amendment proponents for gun control are trying to strip the constitutional rights of the Americans to bear and own arms. This is being done by advocating for piece-by-piece and step-by-step dismantling of the amendment. This call to dismantle the Constitution is to transfer power from the people to the hands of the minority ruling elite. The gun control laws started way back in 1934 when a Federal Gun Control Act was passed. This law restricted the sale of automatic weapons like machine guns to the citizens. In 1938, another act followed that prohibited the people convicted of felony from possessing weapons. In addition, all the dealers and sellers were to be licensed. These laws induced gun control and restricted availability of guns to the people of America. Another act of 1968, on gun control, regulated the use of imported weapons. In addition, those who were mentally stable, minors, those convicted of a felony, and the people who used illegal guns were forbidden from possessing weapons. The Brandy Handgun Violence Prevention act was put in place in 1994. This act placed a five day waiting period for those who wanted to purchase weapons. There are State laws that have been put in place regarding the second amendment. Most states consider it a crime to leave weapons in a place that can be accessed by minors. Moreover, carrying a weapon require a license in many states. In addition, many states regulate sales of weapons through licensing and regulation4. The Obama administration assault on the Second Amendment rights for the American people include; the attempt to ban buying of guns by those who are on the terrorist watch list. This, however, is not an excuse as many nuns, heroes, members of the Congress, children, among others with difficult names and American names are found in the list. This list has been used to deny many Americans their fundamental rights and further strip the fourth amendment. In addition, some law abiding citizens are denied the right to purchase firearms. The legislation by The Government Accountability Office is a testimony to an attempt to strip Americans of the Constitutional right of owning firearms. The Bill Clinton administration claimed that over 60,000 people were prevented from buying guns as they had criminal records. However, they do not inform the public that the crimes committed were with stolen or illegal weapons. The outlawing of the arms only increases crime in the country. This is because weapons can still be obtained in the black markets easily and readily. The control of guns only makes it worse for the aggressor. In addition, the Clinton Administration used the children safety as an argument for their collective agenda. They used this to strip the Americans of their Constitutional rights. They used the excuse that controlling and regulating the gun would protect the children. After the defeat of the gun legislation, the former president said the defeat was for the safety of the children of America. This agenda for control of the gun is just a new order in the world. This disbarment will render the citizens armless and at the mercy of the State5. The attempts for amendment of the second amendment have continued. At the U.S congress, a member of the United Nations proposed a bill that was to revoke the amendment. The member said that the United Nations controlled the global military. All homes in the United States were to be searched, and anything that designated as a weapon was to be taken. The bill was killed as it also proposed that the state did not require military, as a result. The Constitution of the United States has an advantage on the possession of weapons over many nations. This is the case where the government is afraid to trust the citizens with the arms. The Obama administration through Eric Holder was using the “Fast and Furious running scandal” to force more regulations on the second Amendment. Eric Holder, the Attorney General, has appeared before the House Oversight and Government Committee regarding the “Fast and Furious” gun-running scandal. The attorney is someone who does not feel obligated to the rule of law or the American people. He refused to make the government accountable to the American people on the concerns of the law abiding gun owners. The attorney supported the Obama administration call to reinstate the former President Bill Clinton ban on the so called “assault weapons”6. Holder supported the re-institution on the assault weapons ban. He believes that the reduction on crime and the relationship with crime situation in Mexico are related to the ban on weapons. The Obama administration through Eric Holder’s Justice Department has seen epic scandal. “The federal government illegally funneled thousands of firearms to the Mexican drug war lords” (Ammoland, 2012). The result was the death of many Mexicans and a U.S Border Patrol agent. However, Holder denied knowledge on how the scandal occurred, yet he is the head of the justice Department. In addition, he is the nation’s chief law enforcement officer. At the same time, he refused to turn over vital documents to the congressional investigators. These documents could help to prevent a more tragic and corrupt scandal from happening again. The administration of Obama believes that the ban on legal firearms from the law abiding citizens could help solve the Mexico crime problems. However, these laws abiding citizens use the weapons for self defense, recreational, competitive target shooting, and hunting. Holder has tried to use the “Fast and Furious” to champion for the Obama administration gun ban agenda. He went further to lecture the Congress on the political game they were playing on an election year. However, the public is only interested in getting the truth on the Mexican drug cartels. They want to know how the government allowed for thousands of guns, to flow purposefully7. The illegal operation was called by Eric Holder, yet he is calling for the ban on law abiding citizens. He is further holding in formation from the Congress. The U.S Supreme Court interprets the Constitution by determining the individual rights. The Constitution amendment calls for elimination of the protection of individual rights to bear and keep arms. In addition, it restricts the powers of the central government, by guaranteeing the basic rights and protecting the liberty of an individual8. The reelection of Obama on a second term could see him appoint judges who will hold views on the amendment of the Constitution. The Second Amendment has been attacked by Barrack Obama. He has done this behind the scenes, quietly, and through regulations plus the BATFE abuses. The gun related legislation has been a thorny issue on Obama’s first term as president. He did give a speech following the shooting of Congresswoman Gabby Gifford’s. However, he has kept silence on the issue and retreated to his den (Sunstein, 2006). The gun bans, gun licensing, and criminalization of gun owners have popped up during Obama’s reelection call. There is a possibility that with his reelection, more draconian regulations will be passed. This is because the Congress at that time will not have votes that they need to defund. Thus, the regulations will just be tucked down as must pass legislations. In addition, the Republican leaders do not seem as people who can shut the government from protecting the Second Amendment. The Supreme Court is another reason why the Obama reelection could see the death of the Second Amendment. The Supreme Court is composed of conservative, liberals, and conservative swing votes. There are vacancies that will be created within the second administration of Obama. Thus, he will have a chance to fill the Supreme Court with his allies. The result will be to have a majority of the anti-gun liberals at the Supreme Court9. Sotomayor believed that Heller was a bad law. The Second Amendment as an individual right to Sotomayor was bad. The Supreme Court would be overturned by margins. This will make the Court reinstate the Clinton and Obama’s administration ban on guns. The Court tried to repeal the ban and define the Second Amendment (Watson, 2011). The gun control will be done by attacking the second amendment10. Conclusion The issue of gun control and second amendment has had an impact on the reelection of Obama and the rights on the citizens. The Democratic Party through the Clinton and Obama administrations has tried to amend the Constitution several times to ban individual rights on ownership of guns. Holder, the Attorney General, has furthered Obamas support for the amendment; this was shown during the deadly “Fast and Furious” in Mexico war on drug barons.
