The second type of model is the criminal restitution, which occurs in which an offender is jailed until he or she pays the compensation for the damage incurred (Pablo, 2006). It is applicable to the crime victims, homicide victims as well as third parties such as insurers. Its characteristics include,
• It is limited to victims of crime.
• It may cover numerous crime-related expenses like time spent in court or medical expenses.
• It is paid with an interest.
Certain considerations are made when making reparations and among them is the financial condition of the defendant. However, filing a lawsuit for bankruptcy does not exempt the defendant from paying the compensation expected. In case the defendant is unable to pay up the expected compensation, personal assets are auctioned to settle the compensation. In addition, a defendant’s failure to pay the compensation in the required period results in an incarceration sentence (Pablo, 2006).
