Hotel in Violation of California Labor Law Gibb reports the case of Valley West days Inn Hotel, located in California, which has violated the California Labor laws. The company has faced legal actions following unpaid wage claims by over ten employees of the company. In one occasion, employees reported that the company failed to pay their wages and claimed that they were ineligible for regular pay. In other cases, the company failed to pay their workers in time, a case that has resulted to legal claims by a number of the employees. Besides, the management has consistently refused to respond to such matters often failing to attend departmental meetings. According to the article, the Valley West hotel manager has justified their actions citing that the hotel has faced an economic depression which has led to its inability to pay wages to the employees. In brief, the company does not have the money to pay their workers. According to the California Law, workers must be duly paid by the agreed date and failure to do so is a violation of the labor laws. According to this article, Valley West Hotel has violated the California Labor laws and must face the consequences of such acts. The Hotel business is a major industry in California that is part of back bone of the economy. This sector employs millions of citizens from across the world and provides large benefits to the government. The hotels fall within the restaurant industry, which has become more competitive with increase in the demand of fast foods within the country. As corporations, each organization competes by engaging efficient business strategies that will attract more customers and push the organization to top of the market. From this perspective, Valley West Hotel is a major economic contributor that supports the economy of California. Valley West Hotel as a major employer is obliged to adhere to the labor laws of California that were established to safeguard the rights of the employees. In California, Labor laws stipulate that each employer must pay fair wages to their employees and pay the agreed salary in time. This explains why this hotel has faced legal actions for violating the labor laws that government this industry. Besides, the labor laws compel the organization to provide healthy working conditions for their employees as one way of showing their concern for the employee welfare. The Restaurant industry is experiencing more pressure from changes within the business environment. For instance, the demand for better services is compelling them to employ more expert workers. Technological changes are compelling the organization to adopt new strategies of operations, which have become expensive and challenging. The dynamic nature of the business environment is become a big challenge to the restaurant industry. Laguna Beach Hotel Renovation Violates the Coastal Act, Environmental Rules The Laguna Beach is a hotel located in the California coast that has for a long time offered low-cost services to visitors from across the world. According to the article, the Laguna Beach Hotel has considered renovating the Hotel into a better place but with high cost facilities. The Hotel will eliminate various low cost services and upgrade the hotel to an expensive and modest hotel. However, the California Coastal Commission asserts that the company will violate the coastal environmental laws, which will attract a legal action. First, the hotel will invade private land which has always been dedicated to the public if they convert it into a dance floor to serve the hotel. Secondly, the hotel intends to construct submerged rooms, which is against the law and may pose great risk to the coast and the visitors. Failing to consider the Coastal Act is an offense and may contribute to the stoppage of the project. The California Coastal Commission intends to address matters concerning the environment which the Laguna Beach Hotel intends to violate. The Laguna Beach Hotel operates within the Hotel Industry that has become an important market in the country. In California, the restaurant industry has become a key economic sector that provides employment and revenue for the government. Laguna Beach Hotel is a major employer with thousands of employees. For a long time, before renovation, the hotel has served low class citizens providing cheap accommodation for visitors. This explains why the intention of the company to renovate its structure is a major issue since it will affect a great portion of the public. The government is concerned about the changes that will take and how they will affect the members of public. Notably, the Laguna Beach Hotel is obliged to observe a number of regulations while conducting its operations. First, Coastal Act provides guidelines on the utilization of land and the general environment for every company operating close to the California Coast. The law expects all organization to use the land safely and to avoid any form of pollution that may harm the region. The reason why the Coastal commission is concerned about the renovation of the Laguna Beach Hotel is the fear that these renovations may cause harm to the environment. Besides, the company is obliged to follow the labor laws, which denote the rights of the employees and the employer during the time of engagement. The increase in technological advances has positively impacted this industry as it has brought new approaches for construction of Hotels, which are attractive to the public. Therefore, the Hotel industry is experiencing positive changes and this has triggered development within the sector. Part 2: Violation of the California Civil Code 1. The Brightech is a California company that produces mobile phones for the international market. The company has face legal actions for imitating Tecno mobile products to influence the purchase of their own products. The Company was guilty of passing its “Tecno” mobile phones as goods from the original Techno mobile manufacturer. 2. The California Automobiles is one of the companies that produces automobile within the local and international market. The company hides its identity by claiming that their car models are made in Japan and giving them a Toyota identity. The company is guilty for using deceptive designation of geographic origin of their products. 3. The Clearwater Company is a US based company that produces soft drinks for local sale. Over the past ten years, the company has claimed that it has received quality certification certificate from the quality board. However, the quality board established that the company operates illegally. Therefore, the company is guilty of making false claims on offering quality products. 4. The Clear Water Company has also made claims of operating as an independent company, which is a misrepresentation of the source. However, it has been proved that the company operates under a large company known as Assuagers Company that has operated in the country for over 30 years. In this case, the company is obliged to face the law for misrepresenting the source and hiding its identity. 5. The GoodPlus Sacco is a Sacco born from the MetroCash Bank of California that has operated in the industry for a long time. However, at its introduction to the public, the management of GoodPlus Sacco refused to state the connection of the Sacco with the bank to avoid inheriting the bad image of the company. However, the Sacco board has established that the two are connected and may be hiding identify to commit public fraud. From this perspective, the company violates the California Civil Code. 6. The Sparko Electronics Company is a top seller within the US market and has remained a favorite for many customers. Recently, the company faced a legal action after Sony Electronics Company sued it for disparaging their products. The company’s advertisements have termed Sony’s products as inferior, which is against the Civil Code. 7. The FineTech Company is an organization that sells Second hand electrical goods to the public. However, in the last one year, the company has made several claims that particular products are original and that they were brand at the time of selling. A number of customers have complained for purchasing electrical goods that are repaired after the company sales team emphasized that they were original. 8. The Foodpoint Hotel is an organization within the California restaurant industry that offers hospitality services. The company offers various products with the label of “natural” to depict them as natural foodstuffs. A close investigation of the suppliers of its raw materials shows that most of these products such as vegetables are artificially grown and do now warrant to be termed as natural. 9. The IPlus technology goods supplier sells its products with a 2 years warranty sticker. Therefore, customers are attracted to the company for its long warranty period that ascertains the quality of their services. However, a number of customers have complained for the failure of the company to honor its warranty information. 10. The Tablink is a mobile company that started with the intention of selling Tablets to business and companies at a large scale. In 2011, the company advertised its products and one local company requested the organization to supply one thousand tablets to the company. However, the company failed to satisfy this demand, an issue that they had not indicated in their adverts 11. The Smartfurniture is a company that advertised its products and promised large offers for buyers. However, they failed to inform the public that the offer was meant for unassembled furniture only. This ignited a strong reaction from the public who complained to the legal that the company had violated the law for failing to provide enough information about their products. 12. Moreover, SmartFurniture has been accused of advertising high quality furniture but offering buyers lower quality items. This is equivalent to fraud, which violate the civil code of California. 13. Last year, SmartFurniture faced another legal action for advertising unassembled furniture at very low prices and failing to deliver the same to the seller. While the company advertises unassembled furniture, it sells assembled ones at a very high cost. This amounts to fraud which is business law violation. 14. The Devki marker is a California company that sells digital decoders to the local citizens in the US. In the last financial year, the company offered a price reduction for their decoders, a factor that encourages buyers to visit their stores. However, the buyers were disappointed after realizing that the company offered lower quality products after the price cut. 15. Devki Marker also faced a legal action after promising the customers that they would get a 5% off price after purchasing their decoders. After the transactions, the company failed to provide this discount. 16. The CalifRepairer have been condemned for lying to customers that their mobile phones require repair while it is unnecessary. In some cases, the mobile phone require new batteries but the technician lie that the devices needs an expensive repair. Such fraud act is against the public civil code. 17. Silmatt suppliers faced a legal action after indicating that they had supplied stationeries to the office of Auditor general as per the initial order while they had not. After close check of the cargo, it was established that the stationeries supplied were half those ordered by the company. 18. The Matpress contractors entered a contract with Samco suppliers stating that Matpress would offer services as long as Samco was operating within the California region. This condition was unreasonable as it denied Samco the right to contract another company that would offer better services than Matpress. 19. Martins is a sales agent in CalPlus Stationery suppliers in California and works under the authority of the marketing manager, Mr. Stevenson. In June 2015, Martins made a call to the California School and negotiated for the supply of stationeries offering higher prices to the Principal. The sales agent failed to identify their identity hence playing the role of the marketing manager.
