The poor state of the property is enough proof of the inadequacy of its use. Such a state inhibits the use of the property to maximize productivity. As Merriam, Dwight, and Marry note, taking private property by the powers of eminent domain should aim at improving public safety, health, and welfare, among other things (3). It is important that every society is economically stable as this will facilitate the circulation of revenue and other economic advances. Acquiring the property and utilizing it in a manner that promises economic benefits for those who dwell in and around it is, as a result, constitutional. It does not violate the takings clause found in the fifth amendment of the constitution.

Revitalizing the economy of the distressed city will serve to benefit the greater public in aspects such as the provision of jobs and taxes for the city government as well as improving the general welfare of the people. The Fifth Amendment law recognizes the acquisition and utilization of property if it promises to benefit the public in such a manner.
The law also recognizes the importance that the property bears to their owners and, for this reason, asserts that the urban authority should give them just compensation. Read More
