The bricklayer had been trying to maintain his balance and some of the bricks scattered away, out of which few fell near the chute. The end toe board was never on the site. The next thing was that an individual was on the ground, bleeding profusely. The victim was taken to the hospital. It was found out that Thomas West suffered heavy injuries on the scalp. The area, where the incident had taken place, was cleared out. The scaffolds were well erected. The scaffolding contractor documents showed that the scaffolds were erected a day before the hand over date.

At the same time it should be noted that the accident was not reported. The victim, who had suffered from the injury, enjoyed watching the builders work. He did not wear any helmet and jacket and his entry was unauthorized. He used to slip pass by the security guard through the fence. The Health and Safety Executive, is the main organization, which responsible for implementing the necessary rules and regulations related to safety in the United Kingdoms (Sommerkamp, 2004). According to the reports complied by the HSE, it has been found out that majority of the construction accidents take place when individuals are walking near the construction site, mishandling of equipments, etc (Zahlis, 2005).

From the brief overview, it is quite evident that the root cause of the accident is the missing end toe board. The bricklayer had reported that it was missing but no one had taken any notice. This demonstrates the fact that the construction site did not have a safe construction environment. Majority of the laws related to health and safety, strongly emphasized on the rights of safe environment for workers. In the United Kingdom, the Government's Health and Safety Commission has the responsibility to give protection and securing to people by making certain that the risks in construction site or any work place is appropriately controlled.

Legal Procedure because of the Site Accident Frequently, accidents take place in construction site. Fatal accidents, injuries and damages can lead to impairment and even death. It should be noted that construction accidents must be reported in order to prevent future accidents. The first essential requirement is proper documentation process, which is needed in order to ensure that the insurance company is contacted immediately after the incident (Speir,2008). The delay in documentation procedure can create a delay in the entire legal process.
