One thing most people find difficult to live with is perpetual serenity and friendship. Seemingly, the war between nations is ever hereditary from one generation to another provided it never gets solved. One person’s enemy at times happens to be another person’s friend. One ironic thing is that an army might be fighting another army thinking it is a pack of insurgents yet the other party thinks the same of their enemies. Incidents as such keep repeating across the globe due to the initial induced feeling of insecurity.

It is the feeling of insecurity and loss of faith in one another that induces the stiff conflict amongst many fighting nations. We can relate occurrences as such to most Middle East countries with specific reference to Afghanistan. With prisoners of war being captured from both conflict parties of the US and Afghanistan, it is important for specific rules on how to treat such prisoners to be laid down. This study takes an in-depth look at the treatment being inflicted upon Afghan prisoners of war at the hands of the Allied forces.

It is important to acknowledge that these prisoners are being treated unjustly, without regard for basic human rights, and with little regard for commonly accepted practiced rules of engagement. In addition, this section presents the problem statement. The problem statement presents a critical justification for why this assessment and evaluation is a necessary study. The second chapter will provide theoretical analysis on the POWs and by turn, of the IAC and NIAC as well as their role in qualifying a situation as professional or unprofessional.

The literature review will attempt to examine relevant research to explain the conflict situation of Afghanistan and the assessments of POWs. The fourth section will heavily present more political dimension research of this study while taking into account to highlight the legality of the arguments. The fifth section will assess articles answering issues presented in the fourth section. The thesis will discuss and analyze the result of the research in the sixth section.
