Informal Rulemaking (Administrative Law): This is a branch of law that oversees the bodies of government that are responsible for the administration. Government agencies that work under administrative capacity work as a branch of public law and deal with decision making arms of the government. Administrative law is different from legislative or judicial authority because it includes the power to create rules and regulations based on the statutes that legislative authorities put into effect. These bodies also have the power to grant licenses and permits, begin investigations and provide remedies to complaints, oversee the conduct of the business of government and issue orders to parties to comply with certain rules. Administrative appeal is different from judicial review in that judicial review allows the court to look only at the procedures and methods the administrative body used to arrive at the decision, whereas administrative appeal decides whether the decision itself was correct. It is on this issue of due procedure that constitutional and governmental law frequently intersects. The Supreme Court has long held that, governmental decisions that take away or interfere with essential liberty or assets interests must employ a fair hearing before doing so.
