Honesty versus Justice or Due Process versus Crime Control - Essay Example

Whenever such a crime takes place, first there is a process of justification for the action that was allegedly conducted. After that, all the possibilities are analyzed that are related to a particular crime. Therefore, the person is under a trial. Honesty is the most important purpose of all the trials. (Pollock, 2007) If there will be no honesty then there will be no one who will get justice. All the judges have to be honest to give justice to everyone. All the witnesses have to be honest. Therefore honesty and justice go together.

Today justice occupies the part of morality that is identified with the good or someone getting justice. Without honesty, there will be injustice, evil, and wrongness everywhere. Today the current legal system works justice is usually equated with honesty. An honest justice system would give that justice to everyone. (Pollock, 2007).

This paper also explains the due process model. The main purpose of due process is to protect the rights of the accused and it provides a system of safeguards that will help in combating the abuse within the law enforcers and the crime control model which promotes the reduction and elimination of crimes by the agents of law and the police. (Close, & Meier, 2004) When it comes to understanding the Criminal Justice System there is a question that everyone asks, does honesty always help to get justice Justice is defined as a system of law or scheme of law in which every person gets his or her due from this system, including natural and legal rights, while honesty is very important in telling the truth or freedom from fraud or deceit. 

Whenever there is a crime committed around the world, with a possibility that it may be even every hour however, not all criminals who commit these crimes end up in jail for many different reasons. The first reason is that the criminals are not caught by the concerned authorities and even if they are caught by the police, they use top lawyers who will provide legal justification for the crime committed by a particular criminal. (Close, & Meier, 2004) But if the rationale for justice is ignored then freedom from deceit will not necessarily lead to justice.

Sometimes after the detection of a certain crime, Justice and punishment are the most vital areas in international Justice and crime. If a common man is a victim of kidnapping, robbery, domestic violence, murder, and any street abuse then the victims seek guidance and assistance from FBI and police personnel for bringing justice by implementing different legal actions and criminal procedures. Every country of the world has its law or state law of policemen who possess authority and every right on the citizens of that country who are caught red-handed with solid evidence at the time of the commission of a crime.  

In America, the laws for justice and crimes are stringent and very strong, which means that it never lets go of any crime at any point in time whether it be a foreigner, tourist, immigrant, or even a citizen. This is the reason and how the concerned authorities control the level of crime. But there is a problem in the process of detection and investigation of crime, because it is a long and difficult process, and due to this reason, a lot of time is wasted in arresting criminals who then can escape by changing their appearance, disguise, change their names and they even change their passports. There is a great responsibility for law enforcement agencies, including the FBI to catch criminals, so that crime in society should be under the control of police and other law enforcement agencies. (Poulin, & Nemeth, 2004)

Generally, due process and Crime control are two different types of criminal justice. It could be said that they are two extremes. The role of crime control is to protect innocent people and to get criminals out of our streets.  When it comes to the due process model of criminal justice, it is more like a difficult course to getting justice because one has to go through all the legal obstacles to convict the right person. In the United States of America, the courts lean towards due process and the police lean toward crime control as a result, tensions are caused between the courts and the police. Both have their importance but due process is more important. If in America there was no due process then the people with powerful positions could have manipulated the system for their gains. Both systems of justice share common beliefs and they both are important.
