Management The old Workmen’s Compensation Act was initiated at the time of Hammurabi. It was at that time when the laws were enacted and taken into effect. The laws were laid down to make the people work better and also inspire them to work into longer durations. The Act also made sure that people were working full for satisfaction and enjoyment. The laws for the workman have changed a lot during these times and it is pertinent to note these laws with the way they have been implemented. During the old days it was mentioned that each and every workman got enough for his own good and earned enough to survive.

It was made sure that the workman got enough allowances and also remedied for any action by the organization through which they were employed if it was proved that there were malafide actions by the organization. It was later realised as the civilizations moved on to have a better system for the workman’s compensation, and therefore the need to have an Act in place was realised. The Workman compensation Act made sure that each and every workman was given the due compensation for his service to the Government organization as well as private players in the society.

The incidence rate is calculated by the no. of recordable cases when multiplied by two hundred thousand which equals total man hours in period, severity rate is calculated by no. of lost workdays when multiplied by two hundred thousand equals total man hours in period and the average measure of this severity rate which includes all the injuries can be calculated when severity rate is divided by incidence rate. The lost workdays can be defined as no. of days, consecutive or not, beyond day of injury or onset of illness, the employee was anyway from work or limited to restricted work activity due to the injury or illness.

The last working days are counted in such a manner that the days away from work or restricted work activity does not include day of injury or onset of illness but also does not include normal days off until the worker returns to his or her regular job. CHARATERISTICS OF THE STATE LAWS UNDER THW WORKER’S COMPENSATION: Compulsary laws and Elective laws are of the different kinds. Only Texas, New Jersy and South Carolina are elective or in other words follow Elective laws. On the other hand Compulsary laws are of that nature which require its employers to accept its privisions and also provide for its benefits which are specified.

The employers of the Indiana region possibly purchase insurance through competitive market. Exclusive remedy requires the employers to accept responsibility for injuries arising out of and in course of employment without regard to fault. Employees give up right to sue employers for unlimited damages but sue equipment manufacturers, or bring negligence action. The various problems to address in workmen compensation are worker’s lost wages, poor public image for employer, lost productivity, higher production costs, reduced tax revenue, less marketable products, financial burden on society.
