Stone argues that the goals of efficiency, equity, welfare, security, and liberty lie in the natural world where we are the realm of fate and accident (Stone 45). Equity relates to policymaking and requires promotion of legal traditions that deal with remedies such as divorces and similar actions. Liberty entails freedom in policymaking to attain its significance within a society. Liberty ensures law enforces are free to express their opinions and that offenders comply with set laws within a society. Efficiency relates on the quality of policymaking developed while security ensures that offenders do not threaten society members. In the society, welfare ensures that the government provides financial aid when making policies within a society. These various goals assist in policymaking within a society and promotion of legal issues. The goals promote an understanding of causation that describes the sequence of events by which one thing leads to another. Moreover, the social world understands events result in the will of efficiency, welfare, security and liberty that are usually human but perhaps animal. Therefore, the goals depending on the efficiency, welfare, security, freedom and equity, depends on the circumstances that the social world depict. The world needs to portray natural circumstances that show real events to display the goals of equity, liberty, welfare, security, and efficiency. According to Stone, goals need to have a physical touch for the policies to be efficient and create events, which have a series of real activities. These develop equity, efficiency, security, liberty and welfare in the most positive direction. Moreover, the goals promote significant developments in law, policy and the society. Democracy, in policymaking, contributes to effective goals in efficiency, security, liberty, and welfare, which develop law in the society (Stone 67). All the goals are imperative to attaining an ideal political system. Q2 Stone’s Goals Equality Federalist Paper 51 addresses the constitutional provision for partitioning of power among several departmental segments within the state. Stone’s goal of equality offers a deeper insight to the Federalist paper 51’s provision. Equality implies the state of being equal in opportunities, status, and rights. Each departmental segment should have a leadership that freely exercises its powers without limitations by external forces. The power to appoint leaders for the posts of supreme executive, legislative and magistracies lies on the hands of the people. With the power lying on the citizens hands, every individual interested in the seats have an equal opportunity to compete and bargain for it. Federalist Paper 51, points at the existence of different interests for different classes of citizens. If a common interest unites the majority of the citizens then the minorities’ rights will remain insecure. The existence of different classes of citizens contradicts Stone’s goal of equality. Each of the citizens should remain valued and as such, their rights will be critical without majority or minority factors coming in play. Federalist Paper 78 associates the independence of the judges to the protection of individual’s rights. Equality is one of the individual’s rights that require safeguarding by independent judges. Equality ensures that a country’s citizens remain protected and have the free will of disseminating and exploiting their rights as stipulated in the constitution. A fair constitution must factor in equality issues and means of achieving it to ensure that the protection of the citizens rights. The structure of the government must amend the gaps that exist in the variety of its departments in ensuring equality to its citizens. There should be equality in power distribution to departments of equal ranks. An authentic law should favor all the citizens by offering them equal opportunities in expressing their freedom. Liberty Federalist Paper 51 highlights the oppressions and insecurity of rights that still manifest in the forms of government. The forms of government violate the need to establish equality in adopting policies. States should consider every individual’s opinion regardless of their age or gender in evaluating concerns and issues related to governance. The happening contradict Stone’s second goal of liberty. Liberty refers the state of being free within a state or society from oppressive restrictions that the respective authorities impose on one’s way of life. According to Federalist 78, an individual’s oppression still has means of occurring from the courts of justice though to the minimum limit. The courts of justice can never endanger the people’s liberty. The judiciary should remain distinct and different from both the executive and the legislature. The legislature prescribes the rules that focus on regulating the duties and rights of every citizen in America. The provision defies Stone’s liberty goal since the citizens’ free will remain compromised. The right to vote and adopt a system that will govern and control the citizens should lie upon the citizens as the subjects. Effecting amendments on the provision will create an ample room for the citizens to express their freedom with minimal interference from the executive quarter. Q 3 Concepts from problems or Solutions Sections of Policy Paradox That Help Change Policy Position The first concept that helps change policies is the notion of policymaking. Stone suggests that policies made and deliberately designed through careful propagation assist in changing policy positions. Besides, policy entrepreneurs’ help in the shifting of strategy areas, which are organized. As a policy adviser to a politician attempting the changing of position from tough sex offender restrictions, to a more rehabilitative system that reduces post-incarceration civil restrictions for sex offenders, I would advise the shifting of policy positions. Stone suggests that the concept to change policies assists the politician in changing his or her position on policies of sexual restrictions that reduce incarceration on civil restrictions for sex offenders. The changing of plans, tend to make changes on positions of sexual delinquents. It changes policies to a more comfortable position, which enables sex offenders survive in the society comfortably (Stone 102). However, the shifting of policies on sex offenders need to take positions, which enable the society to live peaceful with minimal or no cases of sexual offenses. Therefore, the changing of policies assists in changing laws to a more rehabilitative system. This encourages societal comfort that enables well-being and reduces offences on some of the crucial issues that lawbreakers develop. The second concepts that assist the politician in rehabilitating sex offenders include institutions of politics that select policymakers. These institutions include political parties and individuals. The political parties tend to influence the implementation of policies that affect all the laws within a country. For the sexual rehabilitation law, the political parties will pass laws and select policy makers who tend to rehabilitate lawbreakers in way that is more positive. These concepts assist the politician in making a position accepted in the society. This is because political parties move into deciding on the position of sexual offenders appropriately considered within a wide pool of individuals with concrete decisions that promote and respect societal culture. Therefore, the institutions of politics that select policymakers influence major decisions on policies. The rehabilitation of sex offenders by the politician, influenced by political institutions in policymaking, tends to have considerations on the society well-being. This greatly assists in the incarceration of civil restrictions for sex offenders by the politician. The third concept entails the role and contribution of policy entrepreneurs. Policy entrepreneurs are institutions and individuals dedicated to advocating policy solutions. Political institutions influence in any public agenda is relatively costly and unreliable hence policy entrepreneurs assist in the process of policy solutions. The role-played by policy entrepreneurs in policy solutions affect laws within a society. Incarceration on civil restrictions for sex offenders by the politician will need the assistance of policy entrepreneurs in coming up with relevant policy solutions. The solutions will assist sexual offenders in their rehabilitation and well-being within a society. Moreover, policy entrepreneurs have the mandate to change policy positions by giving relevant solutions on policies not well defined in a constitution (Stone 104). Therefore, the incarceration of sexual offenders with proper solutions on policies will assist in shaping sexual offenders and enable their stay comfortably within the society. According to Stone, the three concepts of problems and solution sections in the book, Policy Paradox, which help change policy positions, influence law and the society. The concepts: policymaking shifts, institutions of politics that select policymakers and policy entrepreneurs assist in making policies that assist societal development in the law. Therefore, in order to have the incarceration of sexual offenders, these concepts need to implement policymaking issues. These helps in making decisions that consider law and societal development.
