Teacher’s 19 December Business Organization, International Business Law and intellectual Property Law Section I have always thought of initiating a business in Western Region. In my views that region has a good market for almost everything. People are well aware of latest fashion, style and trends over there. That is why it will be really easy to capture a huge market in that region. I am fond of good clothing and I want to see everyone well-dressed and dapper. Therefore, I want to start my own business of garments to give people chic style and trendy outfits to wear and enhance their outlook in all aspects. As per the quality and bravura of my garments, I would name my brand as Dress Fits™. I would try to make my company’s attires highly impressive and a benchmark for the people in Western Region. I would initiate my business as a sole proprietorship, since I believe that in partnership things become confused a bit. Also, I have to share my ideas and in the end the profits with my partner and that is not acceptable for me. Though partnership gives me many benefits as well but I still prefer to go with the sole trading to avoid future ambiguities. As I stated earlier that the main advantage of doing business in Western Region is that people know the latest trends over there and it is easy to introduce new designs and concepts in that region as compared to any other part of the world. Besides being trendy and open hearted, there exists a diversified culture. Many people from all over the world are living in Western Region for good jobs and better life style. They would like to wear something in their native style and I am thinking to offer all kinds of dresses that will satisfy needs of wide range of clientele. Therefore, I would get a chance to capture a massive market in that region. Another factor that would be in my favor is law and order. In Western Region, it has been observed since ages that people are truly strict in following rules as compared to any other part across the globe. Therefore, I would be doing my business in a region where I would find many opportunities to run my business as per business laws and earn a handsome amount of profit as well. The threats are also almost none in doing business in Western Region. Like every aspect of life has some pros and cons, similarly doing business in Western Region has some disadvantages too. If we closely observe then its advantages can be disadvantages as well if I would not handle them wisely. Since, I said earlier that people in that region are trendier as compared to other parts of the world therefore I have to be really quick and intelligent while designing the get-ups so that none of my efforts would go wasted. I have to work extra hard to ensure that people would accept and appreciate my efforts in this field. Moreover, again the diversity factor can be a disadvantage too if managed inappropriately. Since, there are people from different parts; therefore with an advantage of a huge market, I have a disadvantage of distinct moods and cultures as well. I have to do a lot of homework to search out what is acceptable and unacceptable for all the people in that region. For my business, different Religions, Cultures, Tastes, Environment, and Beliefs of people can really be a disaster if I would not act sagaciously and swiftly. Besides all these disadvantages, I would still prefer to initiate my business in Western Region because I think that its plusses are more than its minuses. Moreover, I personally like the environment and climate of Western Region and therefore would feel myself comfortable over there. In Western Region, everyone is so busy in their lives that hardly anyone interferes in anyone’s life. In my point of views such type of atmosphere is perfect for people like me who want to do their business with complete concentration and dedication. That is why no matter what, I would definitely want to target Western Region for doing my business there. As overall all the aspects of doing business are in favor of Western Region. I think it is enough of advantages and disadvantages of doing business in Western Region. Now coming to the law and order part of the discussion, I am well aware of the laws I need to follow if I want to survive in an international market. These laws include the Foreign Corrupt Practices Act, the treaty relating to the contracts for the International Sale of Goods, and the Foreign Sovereign Immunities Act. Since, I am going to do my business at international level that is why International Law is very important for all my dealings. It is obvious that whenever a trade is done between two nations, there must be some rules and regulations that are followed to make that trade successful and to eradicate confusions from the trade parties. Similarly, hence I am going to launch my entire company in Western Region, consequently I strictly have to follow the International Law to ensure no ambiguities in all my endeavors. Moreover, it is needed to deal with the multicultural environment and highly diversified nature of people in that region as well. Another factor is the unstable exchange rates that require a consistent and reliable mechanism to ensure a profitable business in Western Region. Section 2 As per my search over the internet, I found out that trademarks, copyrights, and patents altogether becomes the very important part of Intellectual Property Law. According to UAE law, trademarks are for the companies. It differentiates and protects any company’s reputation among people. Copyrights are there to ensure protection of tangible products of a company and the Patents protects the inventions of a company. They function in a way that no other company can use similar symbols, designs, and patterns to publicize their products like any other company. Trademarks, Patents, and Copyrights are to protect the uniqueness and the individuality of any company. Well-designed trademarks can attract a wide range of clientele due to its unique design and creativity. In UAE there is a law no. 17 regarding patent protection. The patent protection is issued by Industrial Regulation and Protection of Patents. It is then replaced by another law i.e. Federal Law 31 in the year 2006. The federal law states that the patent issued in UAE can be applicable only in the seven emirates as Abu Dhabi, Dubai, Sharjah, Fujairah, Ras-Al-Khaimah, Umm-Al-Quwain, and Ajman. Same is the case with Trademark Law. It is also issued by state and federal law. Also, for copy writing, there is a law in UAE as Copyright and Authorship Protection Law No. 7 for all the copyrights related protections. According to the law, one has to submit his or her work in the Ministry of Information and Culture of UAE. It is then all the work is reviewed and protection is granted. Normally, in UAE protection is provided for writing work, musical work, designing work, titles, and software. This protection is approved for the lifetime of the person seeking protection for his or her company. In most cases this protection is even valid after the death of the protection seeker till 50 more years. Now let us bend the discussion towards trademarks. Why trademark is important for my business. Starting from the most significant factor and that is to ‘be known in the world’. As I said, I perceive things differently, when it comes to persons’ apparels. Therefore, I want to make an impressive name in the market of garments and clothing. To be unique, my business must have a matchless name that no one can duplicate and for that I definitely need a distinctive trademark for my company. It would be beneficial for my company in many aspects like when people can recognize the trademark of my company, it would be easy for me to make a name in the market. Moreover, if I am using a trademark for my company then no other company can sell their designs with my brand name. Besides that having a trademark looks professional for any business. It is a kind of surety that the company is legal and is operating as per Intellectual Property Law. Thus, in my views, trademark will help my business to succeed in all possible ways. Supposedly if any other company tries to breach the Trademark Law then it will surely affects critically on my business. Again all the competition is based on unique ideas and exclusive quality that I would be giving to my entire range of clientele. Whenever anyone tries to use my name for his or her brand and that would be of low quality as well, then definitely it affects my prestige adversely. However, if the other company did offer a good quality clothes, even then it would directly affect my business. It will shatter all my clients and make them ambiguous about the original brand. In the end, I would like to comment on the UAE laws regarding prevention against breach of Trademark. Now the UAE law does allow the nominative usage of the Trademark like “Fish-Fri” is a trademark of one company. Now another company can use “Fish Fry” such a use of a trademark is known as fair use or parody and it is somewhat permissible in UAE laws. On the other side of the picture, the government of UAE has ensured that all its nationals should rules and regulations in every matter, especially when it comes to Copyright, Patents and Trademark Laws. The government is really authoritarian to ensure that these laws are completely followed by the companies who are doing business in that region. If somehow the government finds any company not abiding by these rules then their chastisements are really hard-hitting. Besides that, in UAE the overall situation for all kinds of Laws are truly strict and hardly anyone can escape from the penalties over there. Also the current situation of law and order is efficient enough to deter future crimes as well.
