What constitutes a “fair trial”? Based on the democratic ideals, in a fair trial the rights of the defendants are honored throughout the trial. This implies that the trial is handled under the established law and due process, and the ruling is handed down by a neutral body.
What is the due process of law? The due process is the right to a fair treatment and the defendant has a fighting chance when confronted with a legal action. The admission of the stocking tops did not deprive the defendant of a fair trial. Therefore, he was not denied the due process of law. What was being done was just gathering evidence, and the authorities had the right to access his house.
General Admissibility of Relevant Evidence is applicable in this case. It provides that all evidence that is relevant is admissible, although with certain exceptions, and that irrelevant evidence is not admissible.
