INTRODUCTION
Amendment bill 2012on retailer was moved in order to allow retailers to open on Boxing Day which is a change from the current law that requires retailers to close on public holiday such as Easter Friday, Christmas and Boxing Day. It prohibited any business to take place but allowed Sydney CBD to open on holiday because only volunteers were allowed to run business while employees take time off. The holidays were meant to give employees time to catch up with friends and relatives therefore, bringing contention between government take, retailers, unions and employee since, there is trade-off between value maximization of government and retailers with employee social welfare (Baird, M. 2012).
Retailer position on amendment bill 2012
Retailers supports the amendment bill 2012 to allow the retailers to open on boxing day since according to retailers they assume that opening on boxing day will increase level of sales and they will be able to scale up their sales which is currently decreasing due to increase in the use of online stores. Therefore, retailers argues the bill on the following basis,
Retailers considers amendment bill 2012 to be a master piece, since the bill gives all the retailers equal chance to compete with those allowed to open on holidays and online stores. Therefore, increasing the level of turnover despite the downturn currently experienced in retail industry (Australian National Retail Association. 2012).
Thirdly, Retailers are in support of amendment bill since the bill is considered to correct the flaws that were left in the current law concerning public holiday. The flaws stated is concerning the mean of word “closed” since it prohibited any activity taking place around business premises thus hindering the running of the business due to shortages and compromising with quality of the products. The bill will enable retailers to overcome this challenge since they will be able to develop continuous production cycle thus allows business to run smoothly (Australian National Retail Association. 2012).
Retailers also are in support of the bill since opening of retail shops on Boxing Day because it enhances economic growth since the move will increase sales therefore, increasing government revenue through taxes will it can be channeled to other economic development projects that will improve the citizens standard of living (Australian National Retail Association. 2012).
Lastly, the bill will be added advantage to consumers since it enable them to shop during Boxing Day without going to Sydney CBD. Consumers are in support of the move due to reduced proximity to the goods unlike the current law therefore, making retailers to be in support of the bill since they will be able to tap the demand from consumers who are not willing to go shopping at Sydney CBD (Australian National Retail Association. 2012).
Reasons of union involvement in take the time campaign
The bill is greatly criticized on basis of social welfare of the community since the employees will be pressured to work on Boxing Day despite the bill stating that the employee will be freely elected to work during holidays. This will reduce the time employees have with relatives and friends therefore, compromising with the social well-being of the society thus increasing stress related cases and degradation of children morals due to lack of close parenthood (Inside Retail. 2012).
The bill is also faulty on unions’ perspective they are for the take that opening during Boxing Day will not change economic condition of the country since spending is constant. Opening retail shops during Boxing Day will only redistribute customers from going to those retails allowed to open in Sydney CBD therefore, the bill have no real effect on economy but great negative impact on social welfare of the citizens (Inside Retail. 2012).
Workers perspective
Employees are not in support of the amendment bill 2012 due to a number of reason brought forward by the employees’ representative. This reason includes,
Employees being forced to work on Boxing Day and eventually on other public holidays though the bill only allow employees to be freely elected in order to work during Boxing Day. This has raised concern among employees since it will interfere with their social aspect of life since it will reduce the time they spent with their relatives and friends. In addition, passing of the bill will lure legislature to reduce restriction on other holidays such as Christmas thus making employees work for a full year without having time to rest and catch up with friends and relatives. Therefore, forming basis of rejection of the retail bill (Robertson, J. and Cotsis, S. 2012).
Lastly, employees believe that allowed by the current law on public holiday in Sydney CBD will be enough to satisfy demand during Boxing Day. Therefore, the bill has no meaning since consumers are able to obtain what they need from the available retail shops. The bill will also compromise with the current condition of the allowed retail shop in Sydney CBD which only allows volunteers to run the shops during Boxing Days since they will be tempted to recall there workers to work on Holidays thus making holidays useless (Robertson, J. and Cotsis, S. 2012).
My position on amendment bill 2012
I am in support of the amendment bill for retailers to open on Boxing Day drawing my argument on two perspective. First is on economic consequence of having retails open on Boxing Day and secondly, on the equality of all the retailers to compete favorably (West, A. 2012).
On economic implications, we are able to note that there are consumers who will forego going to Sydney CBD for shopping due to distance and therefore, having retails shop open will reduce proximity thus allowing this type of consumers shop on Boxing Day thus enabling government to tap extra revenue through tax. Retailers will also have increased return thus enabling them improve their profit margin therefore, enabling them to expand level of operation hence increase in employment level and business activities which is a positive indication of a growing economy.
According to equality in retail industry, retailers will be able to compete favorably since they all stand on the same ground to tap on massive demand during Boxing Day since consumer are known to do impulse buying during holidays thus enabling each retail have equal chance in benefiting from such demand. Opening during Boxing Day also enables retails to have continuous production cycle therefore, reducing cost and ensuring that there is no shortage after holiday or ensure freshness of the products sold in retails dealing with perishable goods.
In conclusion, we are able to note that there is much to support in passing the bill into law since no one will be forced to work during Boxing Day because one need to freely consent on whether to work or not.
