Once, Tyrion is taken to the police and is handed over to Bolton, the supervising sergeant, all the officers at the police station gave him a hostile reception since they were made to understand that he was ‘Rob Stark’. As Bolton, the supervising sergeant allows Tyrion the right to remain silent, and the right to have an attorney, he is moved to the interview room under close check but his right to an attorney is denied because the attorney does not appear during his arrest(Ripstein 200).
Apparently, due to his condition at the time of arrest, he suddenly passes out and when he regains consciousness in the hospital bed, he has injured in his body, an indication that he might have been tortured at the police cell.
Conclusion
Tyrion has to claim the arrest of mistaken identity and the torture at the hands of police since he was not the expected scum (Ripstein 200).
Case Two
The Issue is whether Cooper, Fowler, Hofstadter, and Wolowitz committed criminal offenses after the comic book night to be probable as Criminal offenders
The event of Wednesday night as the comic book night had brought friends together. Nevertheless, after the comic night, these friends engaged themselves in various criminal activities that could lead to arrest (Abbott 95).
Articulating and Analysing the Rule
In this case, Amy Farrah Fowler, ex-jilted lover to Cooper has committed criminal offenses because she is in possession of a stun gun, and she has also managed to cause fire to the adjacent building from where she had caused intimidation to Cooper and Hofstadter by ordering them to undress as gunpoint and further burning their clothes. Similarly, in defense Hofstadter commits a criminal offense by grabbing the knife that was in possession of Cooper and stabs Fowler in the abdomen four times before he and Cooper runway. Previously, Cooper has used the same knife to stab Fowler in the bid to defend himself and Hofstadter from Fowler’s attack (Abbott 95).
In regard to Wolowitz, he has committed a criminal offense because he has willingly accepted to take a date from an undercover female police officer who happens to have disguised herself as a prostitute. Due to this, Wolowitz additionally insults the dignity of the female police officer by suspecting her to be a prostitute.
Conclusion
In a general sense, Cooper, Fowler Hofstadter, and Wolowitz are probable criminal offenders because of their actions even though some are as a result of defending themselves (Abbott 95).
Case Three
The Issue Is whether Tom was Bond To Honour his Part Of the Contract to Bob even after being declared as mentally incapacitated
It is apparent that Tom and Bob had known each other for a considerable amount of time because they had both completed a number of contracts in the past. In light of this, It was not difficult for Bob to honor his part of the contract, which entailed the painting of the exterior of the barn (excluding the roof) as the agreed amount of money that was stipulated in the letter that served as the form of agreement( Monahan 2)
Unfortunately, upon completion, Bob realized that Tom's part of the contract could not be completed because he was suspected to be mentally incapacitated for the past one year meaning that during the time that the contract was made he was mentally incapacitated.
Articulating and Analysing the Rule
In light of this, Barbara the guardian of Tom refuses to pay any type of contract that she has not authorized hence Bob decides to sue Barbara to seek payment (Monahan 2).
In essence, once Bob makes his final move to the courts then the court will be expected to deliberate on the matter through making various investigations. Of importance to note is that in the breach of contract, a judgment is not made according to what is in the mind of the concerned parties in the contract but according to what the concerned parties have written said, or done.
Conclusion
Hence, the probable verdict of the case is that Barbara and Tom will be expected to honor their part of the contract despite having Tom as mentally incapacitated for the past one year and pay him his dues. (Monahan 2).
