Public Art Commission Project Brief Blue Spring Contemporary Art Sydney, Australia Project Overview In line with our mission, to serve the public by appreciation of culturally and linguistically diverse community, Blue Spring Contemporary Art Museum seeks to source a Chinese or Australian artist with aware of Chinese history and culture to work alongside our curators in developing a potential blockbuster exhibition for a the first quarter major exhibition in 2016. The exhibition will serve historical, scholarly, aesthetic and financial ambitions of the museum and complement other Chinese objects collected with care in the museum. The project will be under the executive authority of a commission comprising of members from museum management team, sponsor corporations and trustees. The commission will specify the qualities, receive feedback, oversee the timeline and discuss changes for the work. Project Budget The sculpture(s) materials, designing, fabrication, temporary employed curator’s fees, transportation and insurance amount to &120,000 Design Description The work of art must indicate a specific time in the history of China, the reason(s) that the work served and its comparison with the current Chinese history or elsewhere, the location or the city and other specifications of size or quantity that reveal distinct attributes. The work must feature the current features of artefacts and be average in size to for both outdoor and indoor exhibition. The material may not necessarily be specified but it material chosen will align with transportation and maintenance considerations. NB: Applicants MUST deliver a single or multiple rough project they intend to carry out for the work of art. Eligibility The professional working on the exhibition must be a curator with extensive design and art work experience. A Chinese curator must have lived in Australia for at least four years and reveal a pragmatic approach and mysterious intuition to build a work art that is relevant to both Australians, Chinese and others audiences. Australian curators must shos expanded skills in Chinese cultures or proof to have worked with Chinese curators for at least a year. Application and Selection Process Application for curators starts on October 25th and closes November 10th at 5 PM. It is paramount for the applicants to send their identity and address details, digital or pictures of past work of art and the organization(s) worked/working for (optional). Applicants will receive selection outcomes the morning of November 30th. NB: There is no application fee for this opportunity. We will cap application at 100 people. The artist is an independent contractor in this work carrying out supervision, materials, supplies, equipment, labour; travel expenses and any other incidentals except as it would be discussed or provided. The artist will conduct and complete work is a professional and competent manner. 2.0 TIME SCHEDULE The artist will commence work upon effective date of the contract and complete work as per specification of phases under the contract. Effective date is determined by the date the artist and the commission sign the contract. The effective date of the contract will be as the artist and commission last required signature. However, time for completion may be extended by the commission in case there are delays in receiving materials, designing, fabrication and installation due to unforeseen circumstances when signing this contract. 3.0 SCOPE OF WORK 3.1 Description of Work The artists will complete all design refinements, fabrication and installation to substantial conformity with agreed design of work, stamped structural engendering, conservation review and perform and describe all tasks as indicated. The design will be attached to the contract and will be the reference that will be used by the commission to confirm the deliverables and that the work set is fully delivered. 3.2 Location The artist will carry out installation of completed work at the Exhibition Yard Site. 3.3 Other Obligations Any other obligations necessary will be the responsibility of the artists including the clarifications needs, site preparation or modification, lighting, specification of site conditions, anchoring devices and other information. 3.4 Identification Plaque The artist will develop and install a permanent identification plaque as part of or near the work with a specified format as: Title Artist(s) Name(s) Year of Installation Medium Blue Spring Contemporary Art Museum In partnership with (Sponsors) Accession # 1-2 sentences to encourage discourse on the work 3.5 Coordination With the Commission The artist will attend all construction work and attend coordination meetings with the commission, museum’s curators and architects, others parties and appropriately deal with communication as scheduled throughout the work and ensure integration of the work. 3.6 Additional Documentation It is required that during the execution of the contract, the artist will prepare and present detailed drawings, respond to conversation reviews and give other documentation that will be used to make catalogues and analysis of the parts and whole work. 4.0 CHANGES TO WORK BEFORE COMPLETION The artist is free to request changes to the design during the execution process, fabrication or installation. However, significant changes must be discussed as per the following procedure: A. Artist present proposal for changes in writing to the commission for review and approval. The description will indicate changes to the scope, concept, and materials, location of work and dimensions and impacts to installation and schedule as well as future maintenance of the work. B. The Commission will review and consult with other stakeholders. If changes are approved, the contract will be updated and attached as new reference. C. Any changes to costs resulting from such changes will be fully under the responsibility of the artist. No extra payment can be authorized unless the changes are brought forth by the commission itself or as a collaborative consideration. 5.0 REVIEW OF WORK The commission or its appointed representative will obtain all the rights to look review the progress according to reasonable times to evaluate and monitor performance, quality assurance and compliance as set under the contract. The commission will require presentations from the artists and documentation of work progress in order to determine whether it will work with the completion phases and as outlined for each phases or section for payment purposes. 6.0 FINAL DOCUMENTATION Prior to release of full payment, the following documents must be submitted to the commission: A. At least a page of statement about work that can help the public to understand the work. The description of work, intent, imagery, historical and construction techniques, materials used shall be submitted on Word document, CD and hard copy. B. Updated professional resume of the artist C. High resolution JPG images from the primitive stages of development to entire completed work. The digital images will be compiled in a CD with the right separations and photography credit. D. The document MUST have a warranty and details it for each part of the work. The warranty will be in line with stamped and agreed engineering documents as licensed by the state including the materials and installation techniques. Any faulty installation or use of inferior materials leading to defects will result to payment of any loss and damages from the artist. 7.0 EXHIBITION AND PUBLIC EVENTS The artist MUST participate in the first exhibition related to the work especially the dedication ceremony, educational outreach and public presentations. The artist need to confirm flexibility to avail during public events as mutually agreed with the commission. 8.0 PAYMENT 8.1 Payment for Work The artist will receive payment for the completed work and any other services related to the contract. The payment will act as full compensation for work performed or rendered for the completion of the work. The total amount to be paid shall not exceed what is specified in the contract despite the resulting revenues from the Sydney sales. Based on the use, sales and taxes, it is estimated that the artist will receive dollars in payment of work done after the completion of the work such as during events. The payments will also be delivered according to tax payments of state residency requirements in Australia. No payments may be done in anticipation or in advance to delivery of supplies and services as specified under the contract. Payment for supplies will be made once the products delivered compare with the specification of every order. The art commission shall authorize such payments and the final payment once the work is accepted by the commission. Every payment will be documented with receipts given to artist and suppliers and copies retained to promote the final invoice voucher and confirmation of receipt of payments as listed and required. The final payment must follow a 30-day retainage period commencing from the date the last installation works in done which is installation of identification plaque. 8.2 Payment Schedule Payments are broken down into five stags including the final one and will be made in regard to the percentage of work completed as set forth in the design. Stage 1 $ 14,000 upon delivery of materials and completion of 5% of the total work Stage 2 $ 18,000 upon receiving all the supplies and completion of 15% of the total work Stage 3 $20,000 upon completion of 55% of the work Stage 4 $30,000 upon completion of 90% of the work Final Stage $38,000 after installation work (30-days after the last installation date) 8.3 Taxes The artist will incur all applicable taxes, State sales, use, excise duty, local taxes that may due from him/her resulting from the contract. However, any assistance may be given by the commission for the artist to contact the state department to determine the eligibility for use and purchase of supplies or services under the contract. Artist residing in New South Wales must be registered with the State department of revenue. They should also take responsibility of remitting the required sales tax and should the rates changes during contract performance; the artist will pay any prevailing tax rates to the department. For artists out-of-state, they commission shall remit payment to the department of revenue. 9.0 ARTIST AS AN INDEPENDENT CONTRACTOR The artist engaged in the contract is not a permanent employee of Blue Spring Museum. He/she will not claim to be an employee or officer at any time when such confirmation may be required by other agencies. In addition, he/she will not accrue any benefit, right or privilege that the state may authorize to other employees. The conduct and control of the work until completion is solely mandated to the artist. The artist may execute the work at a preferred location other than what is specified by the commission. The artist will make all the payments related to the work, costs including the materials, equipment, labour assistants, communication, travel, location or studio space, sustenance, storage, rental and accommodation, documentation, participation and installation. 10.0 RISK OF LOSSS It is the responsibility of the artist to take any loss related to damage or loss of the work during fabrication and especially when the work is carried in the artist’s preferred location. The loss or damages during delivery, transport, storage or completion of installation work will solely rest on the artist. The commission will however expect the artists to provide the insurance policy that covers any damages and loss during fabrication and installation. 11.0 COPYRIGHT AND REPRODUCTION RIGHTS The artists will retain all rights as specified under the copyright law in Australia including but not limited to preliminary research, specifications, drawings, models and subject matter. The artist will responsibly agree and document that he/she is the sole creator of that work and to the best of his/her knowledge confirm that the work is not a replica or has not been displayed in part or as a whole previously. The parts and the whole work should not infringe or violate copyright, rights to privacy, publicity or violate any applicable law. The artist must agree that the work shall be unique and shall have no intention to make similar or additional exact duplicate or editions of the work. The artist will not grant such permission to any other artist to do so except where he gets a written permission from the commission. The artist will grant the commission irrevocable licence to produce and use every graphic reproductions of the work for both commercial and non-commercial purposes. These reproductions can be provided through brochures, exhibition catalogues, graphic media or developed in digital formats. The productions can be communicated and shared through any media including website and the internet. The artist will give royalty-free rights, non-exclusive, permanent and unrestricted. Any work may be reproduced including images, preliminary images and models, completed work during the fabrication, installation and conservation stages. The artist agrees that all the reproductions will bear that artist’s name, the title of work, date, the state in partnership, photography credit if applicable. More details like artist voice, photograph, biography and signature will be incorporated with such publications where applicable especially during display, promotions and further publications. If the commission would arrange to make some reproductions for commercial purposes such as printings on t-shirts, calendar, mugs and others, there will be a separate agreement to set terms of license from artist. The commission will not be responsible if any third party infringe the rights of the artist copyright and will not take responsibility of protecting the artist’s intellectual property rights. When the artist use individuals or imagery that are recognizable, any liability arising from unsecured model, signatures will be totally to the artist and if the imagery is in public domain. 12.0 INDEMNIFICATION The commission shall hold harmless the artist in case there will be claims of damages and costs arising out of any negligent act by the commission. Likewise, the commission expect the artist to indemnify it for any expenses that may arise out of the actions of the artist. Where negligence arises due to artist and the commission, damages will be levied in agreed percentage attributable to both parties. 13.0 INSURANCE The artist will provide insurance policy for the work during the creation to the installation period. The insurance agency must be authorized to do business in New South Wales State. The commission will assume insurance coverage after the completion of the contract.
