Terms and conditions

DEFINITION OF TERMS

1.1. “Terms of Use” are these Terms of Use of studentshare.org, governing the use of the Website and provision of Services by Subscription.

1.2. “Agreement” is a negotiated legal understanding for the provision of Services by Subscription by studentshare.org to its Users, presented by these Terms of Use and establishing the mutual rights and obligations for Users and studentshare.org.

1.4. “Charge” is a fee paid by the Users in order to get a fixed-term (monthly, annual, daily etc.) subscription for downloading Papers, which can be downloaded only on a paid basis. The Charge is the same for all our registered Users.

1.5. “Code” is any computer language used for the creation of the Website.

1.6. “User” is a person registered on the Website in accordance with the provisions of these Terms of Use for the purpose of use of the Website Papers Database displayed on the Website.

1.7. “Contributor” is a Website User, who uploads the Papers to the Website Papers Database.

1.8. “Paper” is an academic paper of any type (essay, research paper, case study, book review, lab report, assignment etc.) uploaded by the Contributors or by studentshare.org. and displayed on the Website.

1.9. “Services by Subscription” shall mean a chargeable service, performed by studentshare.org., its agents, affiliated and authorized persons for the benefit of the Users that allow Users to receive non-limited access to download and use of the Papers* in connection with their use of the Website and provision of access to the Website Papers Database, in order to review, upload, download, as well as search Papers in Website Papers Database within such a fixed-term subscription (period of time is specified in the title of each Subscription, available on the Website).

* non-limited access to download and use of the Papers in Website Paper Database is not absolute. There are limitations for each fixed-term Subscription that does not affect You.
For 7-days access - 150 Papers
For 1-month access - 500 Papers
For 3-months access - 1500 Papers
For 12-months access - 5000 Papers
Such limitations are necessary to protect the content of the Website Paper Database against illegal actions of the third parties that can infringe Intellectual Property rights. If You achieve such downloading limits, you can contact our Website User Support Service by sending the respective request to support@studentshare.org.

1.10. “Website” is a website studentshare.org displaying Papers and intended for the use by the Users in accordance with the provisions of these Terms of Use.

1.11. “You” in the text of these Terms of Use is used to designate the Visitors, Users, Contributors as applicable, depending on the intended use of the Website and Services by Subscription and their status on the Website.

1.12. "Visitor" is any person visiting the Website who is not a registered User.

1.13. Words denoting the masculine gender shall include the feminine and neuter genders and vice versa. Words denoting the singular shall include the plural and vice versa.

1.14. Headings of these Terms of Use are used for the convenience only and shall not affect their interpretation.

1.15. Any reference to any provision of these Terms of Use shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time.

GENERAL PROVISIONS AND RESPONSIBILITIES

2.1. These Terms of Use of studentshare.org., as well as the documents referred to in the text hereof, shall govern the use of the Website and Services by Subscription by Users of the Website and apply to Users of the Website as applicable, depending on the purpose of their use of the Website and Services by Subscription, as well as the role of such persons on the Website.

2.2. Starting to use the Website and/or registering on the Website You hereby confirm that You carefully read the provisions of these Terms of Use, agree with them and undertake to follow all the terms and conditions of these Terms of Use strictly, as well as bear any responsibility in case of their violation or non-compliance.

2.3. If You do not agree with any provision of these Terms of Use, You may not use the Website and Services by Subscription. If, after registration at the Website as a User, You find that any provision of these Terms of Use cannot be accepted by You and/or You do not agree with them You should delete your account and stop using the Website.

2.4. These Terms of Use establish the legally binding rules for the use of the Website, as well as the procedure of Services by Subscription provision.

2.5. These Terms of Use are a legally binding agreement between You andstudentshare.org, the provisions of which shall be binding on all Website Users. This Agreement shall be effective until the complete performance of obligations by the parties.

2.6. These Terms of Use may be modified by studentshare.org at any time by posting the amended Terms of Use on the Website. By using the Website and accepting these Terms of Use, You undertake to regularly review the current version of the Terms of Use posted on the Website. If You continue using the Website and Services by Subscription after an amendment of the Terms of Use, it is considered that You have read the current version of the Terms of Use carefully, taking into account the amendments made thereto, agree and accept them.

2.7. Studentshare.org may at any time without notifying the Users make any changes to the Services by Subscription which are necessary to comply with any safety or other statutory requirements or which do not materially affect the nature or quality of the Services by Subscription.

2.8. Studentshare.org grants to the Users a limited license to access and view samples of Papers displayed on the Website but not to download the same until the Users have registered and paid the Charges according to the instructions on the Website.

USER REGISTRATION

3.1. The ability to make full use of the Website, including uploading and downloading Papers, asking and responding to questions on the Website is available to Website Visitors after registration as a Website User (registration of User account).

3.2. When the User creates an account on the Website, he accepts and agrees to the provisions of these Terms of Use by ticking "I accept the Terms of Use" box.

3.3. Studentshare.org does not charge a fee for User registration on the Website.

3.4. Only persons who are at least 18 years old and can enter into binding arrangements in accordance with applicable laws are allowed to register on the Website and receive the right to use the Services by Subscription and the Website.

3.5. By accepting these Terms of Use You confirm that You are at least 18 years old and all the information You provided is true, accurate and current.

3.6. Persons under 18 years old may use the Services by Subscription and the Website only with the permission and under the supervision of their parents, legal guardians or trustees who are at least 18 years old. At the same time, the fully responsible Users will be such parents, legal guardians or trustees.

3.7. Studentshare.org shall be entitled, at its sole discretion, to deny the User access to the Website and the Services by Subscription, as well as to change/set the eligibility criteria for Users at any time.

3.8. By registering on the Website, You agree to provide true, accurate, current and most complete information, which may be requested on the Website, including, but not limited to, a valid e-mail address and payment details. You agree to regularly update such information in order to ensure their relevance.

3.9. After registration, the User will be assigned an account on the Website. When creating an account, a username and a password to access the Website under such user account will be set. The User’s registered email address will be used as a username to access his account on the Website. The password can be set by the User at his sole discretion.

3.10. The User is fully responsible for security, confidentiality, and safekeeping of his username and password, and for all activities and damage caused by improper storage of such data, their unauthorized use, and for any consequences which resulted or could have resulted from their use in such a manner. In case of infringement of the confidentiality of the User’s username and password, and any unauthorized use of his username and password, the User is required to notify the Website Users Support Service at support@studentshare.org immediately.

3.11. The User agrees that studentshare.org cannot and will not be liable for any loss or damage caused by the User’s failure to maintain the confidentiality of his username and password. The User agrees not to permit the disclosure of his username and password to third parties, except studentshare.org, without the written permission ofstudentshare.org

3.12. The User shall be fully responsible for the transfer of rights and access to his account on the Website to the third parties. The User will be responsible for all acts committed with the use of his account, username, and password.

3.13. Studentshare.org reserves the right to freeze and/or delete uncommitted and inactive user accounts at its sole discretion after 12 months since the last authorization of such account at the Website. Studentshare.org shall not be liable for failure to provide the Services by Subscription and access to the Website to Users whose account has been frozen or deleted.

3.14. If the User provides false or incomplete information or studentshare.org has a reason to believe that the information he provided is false, inaccurate or deliberately untrue, studentshare.org shall be entitled to freeze and/or delete the User’s account unilaterally and deny his use of the Services by Subscription and Website.

3.15. If the User is suspected of having committed illegal actions, including, but not limited to, commitment of fraud with bank cards, distribution of spam, malware, and other acts violating these Terms of Use and applicable laws, studentshare.org may report such actions to the relevant authorities and/or block and/or delete the such User’s account. In addition, by accepting these Terms of Use the Users agree that studentshare.org shall have every right to refuse to provide any Services by Subscription and access to the Website to any User at any time without giving reasons.

3.16. The Papers uploaded by You should not contain information offensive to the third parties, any materials which are obscene, discriminatory, illegal, containing hatred, threats or provocations, calls for violence, violating copyrights of others or material which is misleading or encourages any unlawful action or supports any unlawful or immoral actions.

3.17. The procedure of collection, storage, use and protection of personal information on Website Users is governed by the Privacy Policy, which shall form an integral part hereof.

3.18. The rules and procedure of using cookies and other similar instruments shall be governed by the Cookies Processing Policy, which shall form an integral part hereof.

3.19. Studentshare.org shall be entitled to disclose the User's identity to the third parties appealing that any material/content posted by such Users in any way violate the intellectual property rights or the right to privacy of such third parties.

3.20. The User shall be personally responsible for any materials/content posted by him or by using his User account on the Website, any information he provides to the other Visitors and Users as well as for his interactions with such persons.

UNACCEPTABLE BEHAVIOR

4.1. The User shall be personally responsible for his actions with respect to the Website, studentshare.org. and other Users, as well as data, text, information, content, and links to external resources posted by the User on the Website.

4.2. If a User becomes aware of any facts of unacceptable behavior on the Website, including of violation of these Terms of Use, posting of publications concerning prohibited materials and content, he shall report it to the Website User Support Service at support@studentshare.org.

4.3. Acting as a User You agree to comply with all applicable laws and regulations.

4.4. Studentshare.org shall be entitled to use all available means to protect its rights and interests, including, but not limited to, to suspend the posting of Papers or delete the posted Papers, materials or content related to such Papers without prior notice. Studentshare.org may temporarily freeze or delete the Users account, prohibit their access to the Website and take the technical and legal actions to deny the User’s access to the Website and providing of Services by Subscription in the event of:

Studentshare.org’s reasonable suspicions that the User violated the provisions of these Terms of Use and/or committed illegal or fraudulent actions;
Studentshare.org’s reasonable suspicions that the User’s actions may entail legal responsibility and/or financial damage to studentshare.org, Website Users, and Visitors or service providers to the Website and other persons.

4.5. In addition to other restrictions imposed by these Terms of Use, the User also agrees:

not to send unsolicited, intrusive messages, spam, "chain letters", etc. to studentshare.org and Users;
not to modify or hack the Website or other online resources to misguide someone about the reference of such resources to the Website, their connection with the Website and/or studentshare.org;
not to commit actions of unauthorized copying, modification, use of materials and content posted on the Website;
not to perform unauthorized actions for collection, storage, use or disclosure of Users’ personal information obtained by the User when using the Website or as a result of uploading Papers or obtaining Services by Subscription;
not to take any actions which may lead to the liability of studentshare.org towards any party or which may cause a suspension or termination of Services by Subscription offered by third parties to studentshare.org or Website Users;
not to interfere with the Website operation, Services by Subscription available therein and other Users’ accounts;
not to transfer or sell anyone your account on the Website or username and password to access the Website without the consent of studentshare.org;
not to register on the Website under another username and password, already being a registered User of the Website;
not to duplicate the posting of Papers already uploaded to the Website;
not to use, apply or implement on the Website or in respect of the Website, studentshare.org, Services by Subscription, other Users any malicious software, including, but not limited to, worms, viruses, Trojans, logic bombs and other means which could harm or be technologically dangerous for the Website or the above mentioned persons;
not to attempt unauthorized access to the Website or the servers on which it is hosted, or any other servers, computers or database, other equipment, and technological tools related to the Website;
not to perform DoS-attacks and DDOS-attacks on the Website and/or Users’ pages;
not to post materials and content banned by these Terms of Use or applicable laws on the Website and/or post materials and content which could harm the Website and/or other Users of the Website;
not to perform any other actions, which may violate the provisions of these Terms of Use and/or applicable laws, on the Website.

4.6. The above-mentioned actions can be qualified as an offense entailing the punishment and sanctions provided for by law. In case of such violations, studentshare.org will be forced to apply to the competent authorities to enforce its rights and interests, as well as the rights and interests of the Users of the Website. In case of the above actions, such User’s right to use the Website and Services by Subscription will be discontinued and studentshare.org will be entitled to disclose the User’s personal data and information to the competent authorities and persons as provided for by the applicable laws.

4.7. By accepting these Terms of Use, the User agrees not to upload or download Papers and any other content, which shall include, but is not limited to:

Papers and materials, the posting of which infringes the copyright, rights for trademarks or patents and/or related rights of third parties;
content connected with pornographic materials or actions of a sexual nature, child erotica and pornography;
content promoting racial, religious, ethnic hatred or enmity;
abusive materials, including those related to the violence and/or brutality;
materials related to the surveillance and surreptitious obtaining of information (bugging) etc.;
materials related to the illegal use of databases containing personal information, content which can contribute to the unsolicited mailing of spam messages;
content related to the use of viruses or any other computer codes, files or applications designed to interrupt, destroy or limit the functionality of any computer or telecommunication equipment, applications for unauthorized access, regardless of medium, their content;
any other content, the posting of which is not permitted or is prohibited by the applicable law;
any content, the posting or order of which through the Website could harm the Website, studentshare.org and/or other Users of the Website.

USE OF WEBSITE

5.1. No access to the Website for the full viewing and downloading of Papers shall be allowed until the User has paid the Charges in full.

5.2. The Charges for each fixed-time subscription can be paid by credit/debit card according to instructions on the Website.

5.3. By using Website, You receive Services by Subscription during the fixed-term period that shall allow You to download and use a non-limited* number of Papers from our Website Paper Database by Your own decision. You can choose the best relevant Papers in our Website Paper Database.

We grant you the right to choose any Paper in our Website Paper Database that You believe meet your best expectations, needs, and purposes. If You are faced with difficulties in finding the most relevant Paper, You can ask User Support Service team to assist You by sending a relevant request to the Website User Support Service at support@studentshare.org. Such a request is free of any charge.

5.4. While Your fixed-term Services by Subscription is valid, You are allowed to download new Papers and those Papers that were previously downloaded by You from our Website Paper Database. Upon termination of fixed-term Services by Subscription, We shall clear all history of Papers downloaded by You from our Website Paper Database during the fixed-term Services by Subscription and those Papers shall become inaccessible for re-downloading.

5.5. To renew the access to our Website Paper Database and to download Papers from our Website Paper Database, You should buy new Services by Subscription. For the purpose herein, re-downloading of Papers shall mean the Services by Subscription provided for You in full scope even if You have previously downloaded Papers from our Website Paper Database within the term of validity of another fixed-term service by Subscription.

5.6. If You have faced any payment issues, You can reach out to our support team via email support@studentshare.org or contact form https://studentshare.org/contact-us.

5.6. Following registration on the Website, the Users receive a right to upload their own Papers to the Website Papers database and to receive a reward in a form of fixed-term subscription to our Services by Subscription. For uploading from one to four Papers to our Website Papers Database You shall have the right to obtain 24 hours subscription. For uploading 5 and more Papers on the same day, You shall have the right to obtain a 1-month subscription.

5.7. In order to obtain the reward for uploading Papers to Website Papers database please submit a relevant request to the Website User Support Service at support@studentshare.org

5.8. We will preliminarily review the Paper after you submit it to studentshare.org and we may reject the Paper based on our internal policy at our own discretion. Rejected Paper will not be displayed on Website and reward for uploading to Website will not be obtained.

REFUND AND CANCELATION POLICY

6.1. You can cancel the purchased Service by Subscription during its operation time by contacting The Website User Support Service (support@studentshare.org). Please note that You shall not have a right to a refund if You have downloaded at least 1(one) Paper for Charge during the Service by Subscription operation time.

INTELLECTUAL PROPERTY RIGHTS

7.1. These Terms of Use do not grant the Users any rights to, or in, copyrights, or any other rights in respect of the Papers. The property and copyright or other intellectual property rights to the Papers belong to studentshare.org, but studentshare.org shall grant to the Users a non-assignable non-exclusive license to view and download the Papers for personal usage. No license is granted for the use of Papers for any other purpose whatsoever including, without prejudice to the generality of the foregoing, use in any essay, coursework or dissertation written by the User, distribute, publish, transmit, sell, modify, display or create derivative works from, or exploit the Papers without prior written consent of studentshare.org.

7.2. By uploading any Papers to the Website Papers database, you, acting as a Website User:

warrant that you are the legal and beneficial copyright owner of such Papers and the use of such materials does not breach the third party rights of any individual or legal entity;
undertake not to use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any content and Papers not owned by you;
shall indemnify and hold studentshare.org and the Website harmless against any and all claims, penalties, liability, losses, expenses, fines or damages arising out of our or User`s normal use of your Papers.

7.3. By uploading Papers to the Website Papers database, you agree to sell such Papers to studentshare.org for the above-mentioned reward. In doing so and clicking upload-button, you agree to transfer complete ownership, copyright or otherwise, to studentshare.org. By uploading your Papers, you agree not to upload them to other websites, similar or otherwise, and you affirm that it has not already been uploaded to another website, including your own.

7.4. Studentshare.orgdoes not promise or guarantee that any Papers uploaded to the Website Papers database will be purchased by other Users. Studentshare.org reserves the right to reject any uploaded Paper for any reason. Studentshare.org has full right to use the Papers uploaded to the Website Papers database as the copyright owner once it is purchased by studentshare.org, including but not limited to by uploading the Paper to other websites/transfer or licensing copyright to third persons and other rights prescribed by the law.

7.5. Copyright in any Code used in the provision of the Services by Subscription or the Website shall remain the property of studentshare.org but studentshare.org shall grant to the Users a non-assignable non-exclusive license to use the Code for the purpose of using the Services by Subscription and the Website but for no other purpose provided the Users keeps intact all copyright and other proprietary notices. In addition to the above provisions, any reproduction or redistribution of the Papers and /or Code is expressly prohibited by law and copying or reproduction of the Papers and /or Code to any other server or location for further reproduction or redistribution is expressly prohibited.

WARRANTIES AND LIABILITY

8.1. Subject to any express provisions of these Terms of Use studentshare.org makes no representations nor gives any warranties about the accuracy, suitability or reliability of any Papers displayed in the Website or about their use for any purpose.

8.2. Subject to any express provisions of these Terms of Use studentshare.org makes no representations about the suitability reliability availability timeliness lack of viruses or other harmful components and accuracy of the Website Code and Services by Subscription for any purpose. Studentshare.org does not warrant that the use of the Services by Subscription will meet the User's expectations.

8.3. Studentshare.org shall not be responsible for the outcome of any use by the Users of the Papers.

8.4. Studentshare.org does not warrant that the Services by Subscription will remain fully operational at all times and will not be affected by malicious attacks, viruses, and denial of service attacks.

8.5. Studentshare.org gives no warranty for the quality reliability or service of any third party service provider (if any) and does not warrant that the Services by Subscription and the operation of the Website will be uninterrupted or without error.

8.6. Studentshare.org cannot guarantee that correction of any error or problem will be provided with any specific timescale but where studentshare.org estimates that any correction will take more than 2 working days it will provide, where reasonably practicable a workaround or patch.

8.7. Studentshare.org shall not be liable to the Users or deemed to be in breach of the Agreement by reason of the Website going down for less than 3 days in any month. If the Website were to go down for more than 3 days during any month then the number of days during which the Website was interrupted up to a maximum of 5 will be added manually to the end of the period for which the User has paid for access to the Website and requested an extension by mail.

8.8. Studentshare.org shall not be liable to the Users or deemed to be in breach of the Agreement by reason of any delay in performing or failure to perform any of the studentshare.org's obligations in relation to the Services by Subscription if the delay or failure was due to any cause beyond studentshare.org's reasonable control.

8.9. Studentshare.org cannot guarantee accuracy, thoroughness, and appropriateness of any information or Paper offered on this Website. Studentshare.org cannot provide any guarantees that the Paper will match your purposes or meet your expectations in full. We also do not assume responsibility for any errors which may occur in Papers and materials that You download from the Website.

8.10. The information, pertaining to the Papers, does not constitute a recommendation to use the Papers in any way. The Users represent and warrant that the decision to order and use the Papers has been made out of User’s own initiative, volition, and free will. User agrees that studentshare.org shall not be liable, under any circumstance, for any use of Papers by the User which violates these Terms of Use, or which is unauthorized or illegal.

8.11. Studentshare.org does not offer any advice on the merits or suitability of Papers and no view, or statement or thought expressed by studentshare.org, or its employees or contractors shall be construed as such by the User. Studentshare.org or its employees, or contractors only provides information about the Papers and does not advise Users.

DISPUTE SETTLEMENT

9.1. Studentshare.org carefully ensures that the interactions with Website Users take place in the most comfortable and transparent way for the Users, who adequately comply with the provisions of these Terms of Use.

9.2. In some cases, there may be disputes between the Users and studentshare.org. The Users shall take all feasible and reasonable steps for dispute settlement using the tools and contacts available on the Website.

9.3. Dispute case can be transferred by the Users to the Website User Support Service at support@studentshare.org.

9.4. The dispute shall be considered by the Website User Support Service in accordance with these Terms of Use within 30 calendar days after receipt of the application by the Website User Support Service. After review of the dispute details, the Website User Support Service will make a decision in respect of the dispute. Such a decision would not be considered enforceable by law. Nevertheless, studentshare.org reserves the right to refuse to serve the Users who failed to comply with decisions made by the Website User Support Service.

9.5. The Website User Support Service may consider only those disputes which are related to the Services by Subscription and Papers available on the Website.

10. GOVERNING LAW

10.1. The laws of Gibraltar, excluding its conflicts of law principles, govern this Agreement and your use of the Service.
