The factors that need to be taken into consideration to consider this sanction as a severe punishment are as follows: (1) the ability of the offender to be constrained into a rigid set of self-discipline, (2) the level of intrusiveness given that other family members are present and could be subjected to frequent monitoring; and (3) potentials for the eruption of domestic violence due to the inability of the offender to leave their domicile (Alarid, 2015). Further, as emphasized, “the main purpose of house arrest is to reduce offender movement while being monitored; it does not function to deter crime or to reduce recidivism” (Alarid, 2015, p. 207). Therefore, by the nature within which this sanction is designed, one must emphasize that it is not created to impose a severe punishment, per se.
In fact, it was also cited from Staples and Decker’s (2010) work that “discipline should “ be productive and not simply repressive” ( p. 17)” (Alarid, 2015, p. 206). As such, its being considered a severe punishment would depend on the personality of the offender and the ability to be confined to the home. Abiding by the schedule was both challenging and rewarding. One has actually been accustomed to stict adherence to schedules to ensure that time management is effectively sustained.
There were instances that the schedule had to be revised or violated when some urgent errands or concerns had to be prioritized. For instance, purchasing a shirt, which was scheduled for Friday at 5:00 pm was not followed as per the defined time frame. Likewise, since buying the shirt was not even a priority, one opted to delay it during week-ends, especially when the endeavor could be fitted prior to going to the grocery. In addition, other endeavors, like watching a movie or jogging could also be adjusted, as deemed necessary.
