Summary Gambling, by virtue of being a concomitant functional domain of competence, is regulated at both provincial as well as national level in South Africa. The directives of gambling in the Republic of the country are looked as the consequence of the national policy of reform and the advancement of the nation. Keeping in mind the corroboration of the act of Gambling, along with its assessment as a source of development for the Republic of South Africa, this research puts forward a critical analysis of the Gambling Regulatory Legal Framework of the country.

South Africa, being a unitary nation possessing attributes of a federal system, has nine provincial boards for efficient regulation of the Gambling Industry. However, the federal attributes have somewhat resulted in inadvertent consequences which are critically argued in this paper. It is efficiently proposed that the role of provincial boards is redundant to a certain extent for a simple reason that the exercise of legislative authorities by the provinces on gambling issues has cropped up bewilderment and cost the tax-payers millions of rands in redundant proceedings between the provincial as well as national regulators.

Hence, the idea behind this study is to put forth the notion that the role of provincial employees is significant mostly prior to the licensing, and is therefore, nominal. As a result, the gambling legal regulatory framework in South Africa is required to be over heaved in order to make fruitful use of the much needed money elsewhere from the taxpayers. The elementary issue is apparently associated to whether the provincial gambling boards are still constitutionally pertinent.

This can be adjudicated through a rigorous study about the regulatory framework of United Kingdom which is an ideal example of a pure unitary locale. This paper supports that the functional area of legislative competence in respect of casinos, racing, wagering, exclusive of lotteries and sports pool ought to be eradicated from the provincial orb of the administration and made completely national. The research on the regulatory framework of South Africa is an attempt to critically assess the limitations of the Gambling diligence, and provides with some efficient propositions which are subjected towards the augmentation of the regulatory scaffold of the Republic of the country.
