In a major insurer setback, judges, like Michael Baylson of New Jersey, have rejected the argument by insurance companies about guilty pleas by participants. He conclusively proved that the conduct was merely intentional and therefore, it could not be treated like negligent conduct that aimed at only being compensated by their insurance coverage (National Underwriter 75). In this case, it becomes unclear on who is to blame for medical malpractice insurance fiasco that occurs every day in our healthcare facilities.

Is it the doctors, the lawyers, or the insurance companies? They each consider themselves right and throw the blame on the other. However, since the evidence of such medical malpractices is evident, the root cause has to be determined, in order to completely cure the disease (vice). To deal with such malpractice, doctors who are found guilty in New Jersey are heavily charged for such cases, while other faces long imprisonment. In September 2010, workers of seven hospitals in the US were charged with receiving bribes from the so as to give confidential medical information, which was then used by lawyers to claim compensation for their clients from insurance companies (National Underwriter 78).

Such information was also being used by some doctors to persuade patients to receive unnecessary treatment. Then, millions of dollars are submitted as injury claims by lawyers to insurance companies. This is just an example of medical malpractices that siphon insurance companies, off billions of dollars. This is especially common among private hospitals. For example, Lincoln Medical and Mental Health Center has been a major victim of such crimes.
