In this case similar to that of Nichols v. universal pictures, there are no similarities between what is being said by the plaintiff and that which is actually the case as indicated in the defendant’s book which is being discussed. The protected elements are the literary works that have not been infringed. What seems to be similar is the images of the cat wearing a hat that is used by the plaintiff but these are only designs that are not copyrightable according to the Act.

The literary work has only been broken down into specific parts and not examined as a whole which was also the case in Nichols v. Universal Picture. Examination of the whole book by the defendant has no indication of any infringement and hence cannot be said to have engaged in any infringement of the plaintiff’s work.
Based on the example provided, it is evident that there is not enough evidence of an infringement of the copyright act being committed and hence the case should be dismissed. Read More
