Court Representation "[Click here and type " "[Click here and type your s " Court Representation If an accused person didnot have representation before the bench, it would be a condemnation of our system of justice. Justice is blind and should never look at a defendant before filing a judgment of guilty. To not have an attorney representing a defendant would be a crime. Most defendants cannot represent themselves before a trained attorney representing the government. Due to the cost of good representation, most indigents cannot afford the type of lawyer they might like.
The main goal of any court should be to appoint a lawyer of good standing to support the accused. In some instances, court appointed representation has been less than strong enough to do the job. If payment for services is the most important thing that an appointed lawyer is looking at, then he will not do the best job for his client. Another thing that hurts representation is the pro bono representation of the client. There have been actual cases where the appointed lawyers have been so inexperienced that they were not able to do battle with the government lawyers, and some have even fallen asleep during the trials.
The best thing for our legal system would be to have a line item in the budgets to pay for good legal representation. The item could be funded with a portion of any moving violation that is ticketed by the local police, for the city courts and a portion of any state moving violation for the state courts. This would accomplish two things for the court system. The first thing that could be accomplished is the reduction of outstanding traffic tickets because the city and the state would be aggressive in collecting these fines.
Federal courts could be funded through a line item in the federal budget by taking 1% of the foreign aid appropriations and dedicating it to the fund.
