What can be done now to resolve the issue is to provide another area with all the files so that temporarily both sides are not affected. This will be a hassle but it is important to complete the report anyways. In this way we will not harm the sentiments of both employees. It also means that neither Darlene nor Alice and Frank need to be reprimanded. This will help as the morale of the workers will not be affected. 2. Describe the policy on smoking that you would recommend to Redwood Associates.
“Most states do have regulations that protect workers from tobacco smoke. Some laws directly regulate smoking in the workplace. In Florida, for example, the law prohibits smoking in all enclosed indoor workplaces (except private residences and bars). A few states limit or ban smoking in not just workplaces but in public places as well. Other state laws, however, only protect non-smoking workers through smoking laws that apply to public places or private places.” (Find Law, 2011) The above statements indicate that the laws mostly protect those who are non-smokers.
This means that the laws support the existence of a non-smoking environment. However, this does not mean that smokers are not allowed to work. The indiscrimination acts allow equal right to the smokers and they have every right to get a job. Considering these factors the policy should be such that it should affect no specific side. The proposal which can be put forward should consider the following factors: There should be no area in access of workers where people can smoke. There should be specific sections made outside the working areas where the smokers are allowed to smoke.
However, these areas should not be near areas of work and should be well ventilated. The non-smokers will be assisted and the smoking areas will not cause disruption. The smokers will not have to face discrimination. 3. Explain how this case would change if what bothers Darlene is not old smoke but the smell of Alice’s perfume or Frank’s body odour. This is an entirely different situation. The smell of the body or perfume is completely unavoidable circumstances and Darlene has no right to complain about these issues.
These are part and parcel of the job experience and these issues can not be solved. The best solution of this would be for Darlene to adjust as nothing can be done about it. This is a completely different situation compared to the smoking one. 4. Explain whether it is fair or reasonable for companies to ban employees from smoking in their cars in the company parking lot. This is a critical issue. If the person is smoking in his/ her car there is no one to stop him as he is at perfect liberty to do as he wants.
However, if the smoke is being released into the car park and is harming the environment causing trouble to others this might have to be banned. The following excerpt highlights this situation: In some states, laws prohibit employers from banning employees from smoking outside of the workplace. For instance, in Nevada, an employer may not restrict an applicant or an employee from smoking tobacco during nonworking hours as a condition of employment. Other states bar employers from conditioning employment on whether a worker or an applicant smokes.
