The issue threatened politics of the council, as it appeared that the White majority voted as a bloc, based on race, to eliminate the African American preferred candidate (Curtin, 2002). When the matter was taken to the federal court, the judge found no evidence that the White majority had voted as a block on racial grounds. The judiciary should have no other role in the political process of enacting laws apart from that of protecting people’s rights. In the case of the council of Niagara Falls, the legislative process did not seem to violate the one person-one vote principle and the judge therefore had no business involving himself in resolving it. The judge’s decision seemed to be interfering with a political process.
